Excuse the vanity but you guys MUST hear this. As you know if you have read any of my posts, I use to be an attorney. Well, my friendly local police department just made a HUGE MISTAKE and I can assure you they will pay for it. I post it here, not for sympathy but to show just how eroded our rights have become.
If these cops were investigating a complaint against you, they started out completely wrong from the outset.
They should have detailed what the complaint was about and who filed it. Once armed with that information, if you were innocent then you should have told them that and explained any mitigating or exculpatory facts that would have cleared you of any wrongdoing or made the officers aware of the mistaken nature of the complaint.
By not following that procedure, the police officers were clearly wrong and overstepped their authority.
It is clear your civil rights were violated.
Apparently these officers are not aware of a few of our constitutional amendments and probably a number of local statutes that protect citizens from undue harassment.
Sue the bastards big time.
“This lawyer shouldnt be able to sue and get millions.
“
Can you think of any other means to getting the government’s attention to stop doing this? I’d prefer he gathered a posse to shoot the bastards but this nation is a nation of wussies who would complain even more about that.
Scarey stuff, because most of us are not lawyers and under pressure would not know how best to legally challenge the assault as it happens or to follow up in court afterwards. That is what those jackbooted thugs are counting on, too.
Gee...I can't understand why you are a former lawyer.
Got it. At least you can probably catch bass without harrassment.
Happy fishing!
“The long and short of it is that they soon found out that THEY WERE WRONG!!!!”
Did they find out they were wrong or did they find there was no evidence to charge you?
Dude, Mike Vick said he was completely innocent of dog fighting when he was first charged.
May I correct this statement?
"One of them arrogantly told me that they were recording the whole thing. There is was a type of the entire incident".
Even though every word you spoke may, (or may not), be true, I wish you much luck in trying to prosecute the police for violating your and your family's rights. You say you were once an attorney yourself. If this is the case then you know the fastest way to earning an impeccable win-loss record is to defend the police in Court. Before these six guys are through with you they'll look like George Washington, Abe Lincoln, a priest, a nun, a minister and a rabbi. Meanwhile, they'll try to make you look like a domestic terrorist.
I would highly recommend that you get a court order as quick as you can to
1) provide you a copy of the tape
2) classify the tape as evidence in the criminal complaint against you and your lawsuit against them - so that they will not lose / destroy the tape
Interesting. Thanks for posting.
First I'm not Michael Vick. Secondly, stop being so damn cynical.
I said, they FOUND OUT THEY WERE WRONG. So read it for what it means.
Next time ... if there is a next time. LOCK YOUR DOOR on exiting to your porch. The reason for this is that if they want in, they will have to damage the door (physical evidence) and it bolsters your case that you did not want them in your house.
I am sure you know the meaning of 42 U.S.C. §1983. Now go get ‘em!
>>>>>>>>>>>>>>>>>>>>>>>>>>
DONE.
Who was talking about race? Little tetchy ain't ya?
Two chances of that....Slim and None; and Slim is HIV positive.....
Nah. He seserves to win.
It’s one thing to be a Professor Gates type asshole. It’s something else entirely to insist on your rights.
“Clearly you have never been falsely accused of something and threatened with the law.
Believe me, if it should happen to you, you will be rarin for some payback.”
I have been falsely accused. It was for vandalizing. I was a senior in High School. When the police came, I was out front washing my truck. They scared the hell out of me, but I answer all their questions(I had nothing to hide). They told me to have a good day and I never heard about it again.
I could have been an A$$#0L3, and not talked and tried to make their job as hard as possible. That not only would have made me look guilty, but wouldn’t have help solve the case.
If they did destroy the tape after he filed the complaint, then there is at least one good case of obstruction of justice in this story.
