Excuse the vanity but you guys MUST hear this. As you know if you have read any of my posts, I use to be an attorney. Well, my friendly local police department just made a HUGE MISTAKE and I can assure you they will pay for it. I post it here, not for sympathy but to show just how eroded our rights have become.

No, this actually happened. I hesitated posting it here as I don't really want anymore publicity than necessary. When I sue there will be some, maybe a lot, but publicity isn't the point I'm after. I just wanted everyone to know it can happen.
Further, you should always protect your rights first. Even if you have nothing to hide, talking to the police is a bad idea. You don't know what has been alleged, you don't know what they have in their minds, and you don't know how honest they are. ALWAYS HEDGE WITH YOUR RIGHTS. Worry about "helping" their investigation later.
Where did this take place? Can you post the police report? Was the encounter recorded?
The sergeant in question obviously used the arrest and taking you into custody as the cover for the entry. Very shaky grounds. However, he can also claim he entered your home to make sure your wife and child were not in danger!
Your locale is of primary importance, as this sounds like ("her" sergeant) Affirmative Action Police Nincompoopery of the usual sort. Post the town, and I'm sure you'll find this is not the only time Sergeant Bully has acted in this manner.

BEFORE you go into publicity mode with local media, please contact reputable attorneys who have experience in exactly this line of country. Get those attorneys busy and make some money. Should be good for up to $250,000. Follow their instructions.

Understood. I come from a law enforcement family and I say sue the bastards and don’t let up! Garbage like this makes it harder for honest cops to do their jobs.
There’s a book out now called “Arrest-proof yourself” written by Dale C. Carson and Wes Denham. One of them is an ex-cop. I plan to get this after my vacation.

I wish you well with your lawsuit. We need to weed out morons from the police force...in your case it seems you met nine police officers and all of them are idiots.
Can you give another confirming source for this story, like a newspaper article, or the police report (posted somewhere). I understand the police report is public information and thus is available to anyone who may want to ask for it. Could you supply that?
And then, since there is a court case coming up, could you supply the information concerning the court case that is being filed, when it is filed. I also presume that this will be public information, too — so I’m not asking for any more information than what is public information anyway...
I would like to follow up on this as it sounds like it’s something that is relevant for all of us and something that we should all takes lessons from...
Unless liberty minded individuals are willing to stand up for their legitimate rights and the “rule of law,” you too will soon find yourself wrongly inconvenienced by the police for arbitrary reasons (or no reason at all).

Unfortunately, these individuals will likely bear no personal responsibility for abusing their authority, but taxpayers will have to pay for their breach of the law.

We have almost 9 acres in Texas. One afternoon (about a year ago) I allowed my teenagers to target practice. (A perfectly legal activity here. I was supervising; albeit, from a distance.)
A neighbor called in a complaint (again). The police took the sweet time responding.
Not knowing that the cops had been called, I told the kids to clean up, then took them out to get something to eat. We were gone about an hour.
When we got back I discovered a cop car in my driveway and my door standing open. The cop had just wandered into my house when we didn’t answer the door! He looked about as guilty as a person could be when I busted him.
I didn’t pursue anything (mainly because I can’t afford a lawyer and I hate to make a fuss over things that aren’t life and limb), but it still bothers the heck out of me. I know for a fact that they can’t enter unless they think someone is in trouble without a warrant.
But what’s a citizen to do?
First, cops rarely ask overt questions. You have to find out what they are there for first. Secondly, I don't care if you are JESUS, you shouldn't talk to them until you find out as much as you can. Third, YOU STILL SHOULDN'T TALK without an attorney present.
I don't care if I was accused of molesting an entire 3rd grade class (though as I said it was an accusations of theft) a persons CONSTITUTIONAL RIGHTS apply. If they don't apply to some cases, they don't apply to any.
Your cynical, swarthy attitude just flatly pisses me off. I didn't ask you to believe me, or to sympathize with me, but you certainly have NO BASIS to assume the worst about me. It's people like YOU who act like the Sargent did because you believe that Constitutional rights are OPTIONAL depending upon what the circumstance is.
