Vanity ^ | 8/20/09 | Political Merc

Excuse the vanity but you guys MUST hear this. As you know if you have read any of my posts, I use to be an attorney. Well, my friendly local police department just made a HUGE MISTAKE and I can assure you they will pay for it. I post it here, not for sympathy but to show just how eroded our rights have become.

“Clearly you have never been falsely accused of something and threatened with the law.”

I wrote that there is no excuse for what the police officer did, but this man is planning a getting endless riches because of the police office who made this mistake.

If the officer broke the law, he/she should be punished for his crimes. This lawyer shouldn’t be able to sue and get millions.

The person who posted this sounds like Obama’s buddy maybe it’s just more “racist” cops... /sacr

Another case of jackboots raping Liberty. Sorry to hear about your experience.

Too bad you didn’t think to lock the door knob on the way out. That would have forced them to kick the door in.

I would guess that you’ll be on the receiving end of some additional harassment. You might want to consider getting a a couple of small video cameras with audio to mount near the front door (outside and inside), and have them set up to record (hide and sercure both the cameras and recorder as best you can).

BEFORE you go into publicity mode with local media, please contact reputable attorneys who have experience in exactly this line of country. Get those attorneys busy and make some money. Should be good for up to $250,000. Follow their instructions.

This is excellent advice! Contact reputable attorneys you know you can trust that has experience with this sort of litigation and the laws in your area.

You said — I wish you well with your lawsuit. We need to weed out morons from the police force...in your case it seems you met nine police officers and all of them are idiots.

Well, you can’t say that all of them (that were in attendance) were idiots. Any one of those others (or several others) could have done it differently, but they were not necessarily in charge or doing the talking. They were probably there for support. And in that position, they would not have necessarily been in a position to say anything about it, at the time it was happening. Maybe several of them, afterwards, talked to the one who did this and told him he was *incredibly stupid* too.... (and you wouldn’t know it).

So, a lot of policemen in that kind of position can find themselves sort of “caught” in a situation that they didn’t think was going to happen, too...

“Do you want to live in a “police state?””

I already do. Just keep your head down and mouth shut and the government will leave you alone.

Suffice it to say that I had certified documentation in the house that proved that I had a right to the money I supposedly stole.

Money? What frickin' money? Why wasn't that in your original post? A reported theft, even if later disproved, throws a whole 'nother level of complexity onto the case.

Play this close to the vest, my friend. And follow your attorney's instructions. Interesting case. Could be criminal, and possible civil recourse against the person who filed the false report.

(1) Knock yourself out... go get 'em for all of us!

(2) Put your toe in the legal water locally...
See if they respond appropriately --
...or play the stonewall game...

(3) At the first level of BS within the court system...

(4) Straight to federal court... imho...

That’s what other attorneys tell people (and about their cars, too, if they are told to get out of their cars, that is “lock it up” when getting out). So, likewise, when stepping out, do lock the door behind you. Hopefully you’ve got a key on you to get back in again, in the situation that you’re locked out and they leave... :-)

In that case the cop actually had a right to enter your home. Someone heard shots fired. You and your family could have been lying inside the house wounded or dead. He did what’s called a welfare check. I’m sure he was embarrassed to find that you weren’t even home!

There is no excuse for what they did...But maybe you should have just answered their questions. They may have just told you to have a good night and went about their way.

You would have to be insane to answer these questions with six officers and a camera. It is sort of like a 60minute bombing. Anything you say will be used against you.

Your charge should have been: Contempt of Cop. Its not a crime, but that doesn’t stop them.

You might want to hire a paralegal to check the spelling, punctuation and grammar on any suit you might file, because yours are pretty atrocious.

It does raise “red flags” with a lot of people — but — it shouldn’t change the *rights* that everyone has. And in this situation, it doesn’t matter whether someone is a Democrat or a Republic, or a reported criminal (in the past) and a gang member or a mafia-type guy or just a normal citizen — everyone gets the *same rights* in all cases....

I find — actually — that many here don’t think that “criminals” get the same rights as innocent people, actually... :-)

Yes, we all know that it is the seriousness of the accusation that is important, not following the law.

If there is imminent danger to someone, then, as I understand it, the police wouldn’t need a warrant to enter a home. Absent that, what excuse do they have for violating the law and their sworn duty?

Do you want your freedoms to be subject to the whim of every person that can pick up a phone and make an accusation against you?

Maybe and then again, maybe not. Any competent attorney will tell you to *never answer any questions* — under *any circumstances* — *no matter what*... so that’s what you’re told is the right thing to do — clam up....
