Excuse the vanity but you guys MUST hear this. As you know if you have read any of my posts, I use to be an attorney. Well, my friendly local police department just made a HUGE MISTAKE and I can assure you they will pay for it. I post it here, not for sympathy but to show just how eroded our rights have become.
Please tell me mom and baby went to the hospital to get “checked out” and you took pictures of the bruised arm. I’m sure you know that will really help your case.
Since you said you were a former attorney, what line of work are you in now?
I have no doubt that what you’re saying is true.However,in court it will be your word against the cops’ word.Without video how can you convince a jury (judge?) that it’s *they* who are lying and not you? After all,you’re not a Harvard professor (I assume).My questions may well betray a woeful ignorance of the law and trials but that’s what first occurred to me.
Isn’t violation of your civil rights under “Color of Law” a felony offence punishable by publicly televised, naked, upside-down crucifixion?

I was once like you, believing in just answering all the questions, looking like you’ve got nothing to hide. Then we got “mugged” by the law, and let me tell you, if you DON’T deal with it like an attorney, you may end up paying for it dearly. We did, and suffered the consequences for many years, for something we did not do. I won’t go into details, but lets just say that while some cops are probably overzealous, the DA and prosecutors office DEFINITELY are. In the end, this is all a game, with scum on both sides, its all about WINNING. Justice can sometimes take a back seat..
Used to be they weren’t supposed to come in without a warrant. Why send six dudes without a warrant? Doesn’t make sense. Doesn’t add up.

Yeah..., I know that they all knew what was going on, even if they didn’t all participate in it. There was no dad there, but only a mother and a couple of sons, and then a girlfriend of one of the sons (I think the girlfriend lived there, too).
But, I wasn’t going to hassle with what the police were doing in their job. They surprised me in getting that search warrant. The last thing I knew (from what they told me) was that all they could do was sit and wait and watch to see it it was moved out of the house. And they did station about three cars around the place, watching. So, I knew that. But, the big surprise for me (because they didn’t inform me about it) was the search warrant. When all those police cars from the various departments came rushing up, it was a surprise to me, too — as much as it was to the neighbors... LOL...
I’ll never forget that sight... all those cars coming out of nowhere, from all directions, driving up like maniacs... (LOL...) and then blocking the driveways, and mine, too (and my car in the driveway), all jumping out, guns out and rushing the place (and a couple over in my direction, too...), and then screaming and yelling to open up and they had a search warrant. I was almost looking for the movie cameras around somewhere... :-)
He was “helping police with their enquiries”.
Ooops...didn't know this.Well,that just might elevate the case to an entirely different league.Just hope that the tape isn't "accidentally" misplaced.Or erased!

IF the justice system was full of honest cops and judges and lawyers, then to cooperate would be ideal.
However, there are crooked cops and judges and lawyers, resulting in innocent people whose lives are incovenienced, or even destroyed, because of them. That is why it’s so important that we exercise our rights. We need to protect ourselves from the corrupt people, and secondarily, we also need to keep them in line, make them follow the rule of law. Not doing so can lead to a “police state,” and surely you don’t want that.
I strongly agree.
I just have no illusions of great sweeping successes in such efforts.

That’s a misnomer. You have already surrendered it. The police state exists because we are unable to police ourselves. In some areas, there is less of a need for “overactive” police. But in many areas, we have created super criminals who have exchanged their conscious for a complete disregard for the rights of others. How do you combat that? What do you do about serial killers or mobsters or gangs? Just last semester, we had a guy saw a woman’s head off with a steak knife in the middle of a coffee shop. When the police arrived, he was holding her head. Why? No one really knows. What about her rights?
The other thing I discovered working EMS is that people will lie for almost no reason. When they get under stress, they start lying. When you profess your innocence to the police, you have joined the most popular club in the country. Don’t be surprised if the cops are a bit skeptical.
