Excuse the vanity but you guys MUST hear this. As you know if you have read any of my posts, I use to be an attorney. Well, my friendly local police department just made a HUGE MISTAKE and I can assure you they will pay for it. I post it here, not for sympathy but to show just how eroded our rights have become.

Strangely enough I did make a similar analogy with her though I didn't make it personal and didn't use rape. I said, "So if I'm ever robbed I should just cooperate or I'll be responsible for being shot?"
The court will say the cops were acting in good faith therefore your claim is denied ...

I get it now. If you had been afraid to talk without your lawyer present and asked for this Consititional right, but instead they arrested you and stormed into your house, shoved your mother and infant brother around then that'd be understandable to you? You would have felt guilty because you could have prevented it all if you only sumbitted to their questioning and didn't ask for your rights?
Thinking like this is what eventually creates a police state. You just "shut up and do as they say, whether you've done something wrong or not, so nobody will get hurt". Something tells me that Samual Adams, Thomas Jefferson and General George Washington didn't have this sort of justice system in mind when they decided to fight to the death, if necessary, against King George and his red coats.
Sorry for the sarcasm, but our Constitution was carefully and painstakingly crafted by the Founding Father of America, and signed in the blood of our forefathers, in order that such heavy handed police tactics would be illegal and unacceptable to the citizenry.
Technically, we can only enter if we see a person not responding.

I’m finally at the stage of my life where there’s “no more Mrs. Nice Gal!” Now I’m starting to see that the polite society is the problem. We are too understanding, too forgiving. *We’ve* let them get out of control.
Should not matter what the accusation was if it was false. The Police in this case acted completely out of line, did not possess the proper court ordered documents to enter the premises and criminally endangered the family by their unwarrented armed presence. These stories usually involve the family dog being killed for no good reason and at other times people have been killed defending themselves in the dark of night by police having kicked in the wrong door.

Glad to hear that. And *actually* every last single one of our “conservative FReepers” should agree with that position, too. There’s no excuse for the police violating rights — and — there is no excuse for citizens violating rights, either (as in some I hear wanting to dispense “vigilante justice” at times on these threads...).
And this *has to apply* to all citizens, no matter whether they are conservative or liberal and no matter whether they are Democrat or Republican. All rights should be available the *same way* with all citizens.

Now, that’s one reason why one asks if they are under arrest. If you’re not under arrest, you can’t be “taken down to the station”. Of course, if you are under arrest, you can be... So, that’s one of the first things that someone should ask.

There was no 'one-upmanship' intended. I wasn't correcting spelling or grammar. Look closely, I was trying to say that the police will simply claim there never was a tape. It never existed.

Just as much as that FBI sniper who took out a mother holding her baby ... it’s the courts who decide what is good faith or not, not me. I’ve read so many stories (esp. Denver police) who’ve sided with the cops in cases like this .....
Now, for all of you Christians (which includes me, too... of course...), one should consider this lecture from this law professor. Especially if one thinks that Christians (and conservatives) are coming “under attack” these days, just for standing up for their rights, either as Christians or as conservatives (and/or both...).
And, it doesn’t matter whether we’re talking about a Democrat or Republican or what administration, or who is in power — these rights should be the *same* all the time, in all situations and in all administrations...
