Today, Leo Donofrio, also the Plaintiff in Donofrio v. Wells, is separately filing an official allegation of Judicial Misconduct against Appellate Division Judge Jack M. Sabatano.
Leo will be updating his blog with the official complaint, and I’ll update here as well…
Today, Leo C. Donofrio filed, with the NJ Supreme Court’s Advisory Committee on Judicial
Conduct, an official allegation of Judicial Misconduct against Appellate Division Judge Jack M. Sabatino with regard to the initial stage of this litigation which was originally filed in the NJ Superior Court, Appellate Division. The case, having come directly from an appeal to the New Jersey Supreme Court is now before the the United States Supreme Court, “DISTRIBUTED for Conference of December 5, 2008″ before all nine Supreme Court Justices.
I am very concerned that if the United States Supreme Court requests the official records of the case from the NJ Appellate Division, a fraudulent case file - not including all relevant documents - will be forwarded to the SCOTUS and thereby the case now pending might be jeopardized.A copy of the official complaint - by way of a New Jersey Supreme Court generated form - will be uploaded to this blog shortly.

Thank you for the correction. Hopefully it shows the NJ Supreme Court judges will not risk everything to sabotage their careers.
Still the NJ lower court is trying to sabotage Leo’s case at SCOTUS. Leo needs help. The SCOTUS clerks could point out to the Justices that “oh there is an error” to try to sabotage leo’s case.
Leo’s case has turned up the heat and ****** are pulling out all the stops to stop his case. Somebody has to pick this up in the conservative talk radio or Drudge.
The ***** have threatened the lady who runs Atlas Shrugs 2000 web site via instant messages. The thugs threatened GOP attorney poll watchers during the elections with lawsuits and jail.
We have to get the word out.

Oh, and don't forget "at war with its media," the so-called Free Press who were supposed to attempt objectivity. That died some time ago. Yesterday on here I read of an African American church where significant numbers of congregants were upset that they did not know many facts about BHO until AFTER they'd voted for him upon the diligent media recommendations. They regretted their votes. What kind of "third rail" of truth is this media? It's an enemy of "We, the People."
I firmly believe that if every American knew just what I know, and who the heck am I, about Obama's murky past, they'd not want him as their President no matter how much melanin in his skin.
I somehow got on an email list where a group is contacting all the electors. it looked like a very grassroots deal but they apparently have made a lot of progress. ??
I have not heard about these cases. It seems like the only outlets for this info now are FR, Lan Lamphere’s show and Plains Radio. It is like a total blackout.
Real Clear Politics used to be conservative guys but any negative Obama messages get pulled immediately. The lady who runs Atlas Shurgs 2000 is getting threatening IM messages fro Obots.

If Leo succeeds and say we get Biden or Hillary - they will know that we know that we will not take it and will fight them ooth and nail on everything.

It would be like Rocky, Serpico, David & Goliath, and far more incredible than that stupid Watergate movie plus more incredible than any conspiracy film because it is a true story.
I don’t put much stock in him but, I heard Hal Lindsay say the other night that if ‘o” is not eligible, because of a proper birth certificate, the dim party is disqualified and forfeits the election and John McCain takes over as President-elect, via the SCOTUS decision.
I do not know if this is fact or not, legally. But it makes for an interesting time.

There's an awful lot of misinformation about how this would work going around. If Obama is found by the SCOTUS to not be qualified before the Electors meet, then the Electors pledged to vote for him are released from that pledge and can vote for whomever they wish. They aren't automatically reassigned to some other person.
If he's found to not be qualified after the Electoral College elects him, then it's up to the Justices to refuse to administer the oath of office (assuming he doesn't gracefully withdraw). Still, the oath can be administered by any judge and certainly one willing to do so can be found. That would precipitate the worst Constitutional crisis in our history (excepting the Civil War, I guess). Obama would literally "Not be my president!" and I suspect a large portion of the military would refuse his orders.

Our Constitution clearly states that in order to be President the person must be a “natural born citizen” of the United States. In summary a person born of two parents who are U.S. Citizens and born on U.S. soil is a “natural born” citizen.
Right now there is another case before the U.S. Supreme Court concerning the constitutional requirements of the Presidential candidates. The suit was brought to the Court by Attorney Leo Donofrio from New Jersey and his suit went through the New Jersey courts back in October. Once his case went through the Supreme Court of New Jersey Donofrio brought his case to the U.S. Supreme Court.
Donofrio’s suit claims that both McCain and Obama are not constitutionally eligible to be President. The case will now go to conference before all the SC Justices on December 5th or sooner if the Justices rule for an immediate stay. The Supreme Court Conference of all nine Justices is set for Dec.5th. If four of the Justices vote to hear the case, the case will go forward and Donofrio will be called to fully argue his case before the Court.
According to Donofrio John McCain was born in the country of Panama to parents who were both U.S. citizens which makes John McCain a U.S. citizen but does not make him a “natural born citizen” because he was not born on U.S. soil. This claim may be not valid if the SC rules that the Naturalization Act of 1790 applies which has to do with citizens born to US citizens in the military.
Donofrio also claims that Obama was a British citizen at birth because his father was from Kenya which was a British colony at the time of Obama’s birth.
Obama’s actual place of birth has remained under question because he has not released his original long form birth certificate. Obama has fought through the many court cases to keep his original birth certificate sealed from public view. Obama claims he was born in Hawaii and it was also stated on his web site that he was born in Hawaii and a British citizen at birth. If that is the case, Obama would not be deemed a “natural born” citizen because his father was from Kenya and a British subject at the time of Obama’s birth.
It is hard to believe that we could have Presidential candidates progress all the way through primary elections and the general election without having been certified as to the constitutional requirements to hold the Office of President.
The Electoral College meets in each State on December 15th to vote. They have a duty to vote for a candidate who has met the constitutional requirements to be President so this issue must be resolved. If the Supreme Court rules that John McCain and Obama are not constitutionally eligible to be President, what happens at that point remains to be seen. It will depend on if their ruling comes before the Electoral College meets or after they meet. The most importing thing is that our Constitution is upheld.
The Constitution states: “No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.”
Our founding fathers wanted to make sure that no President of our country had any possible loyalty to any other country so being “natural born” was clearly stated. At the same time, our founding fathers wanted to allow for one or more of them to run for President during the early years of our country. That is why they made sure to add “or a citizen of the United States at the time of the adoption of this Constitution”. This clause allowed that they could run for President because although they were citizens at the time of the adoption of our Constitution they were not “natural born” citizens because at the time of their births our country was still under British rule.
We will know on December 5th if the Supreme Court Justices decide to fully hear the Donofrio case. I have to believe that our Supreme Court Justices will make sure that our Constitution is upheld. Love, (Me)
PS: I have been following the two cases before the US Supreme Court and another case that is before the Supreme Court of California. The cases were working through the courts since the beginning of October. There have been many other cases in various states that were denied due to lack of standing of the person who filed the lawsuit. Now it is clear that Leo Donofrio’s case will definitely be discussed in Conference by the nine US Supreme Court Justices. You can go to the US Supreme Court web site and read the docket schedule and to read about any upcoming decisions that are made.
If you want more detailed information concerning the filed documents, just ask me for the links to the documents and information. Perhaps the TV and Print media will report about the cases pending and the Supreme Court actions, but I would not hold my breath waiting for them to do so!
I don’t see it there now! I know it was there for a few hours Thursday or Friday. I got an e-mail from a local church about the Donofrio suit yesterday morning and was lucky to get to his blog—he posted a wonderful explanation about “The Supreme Court Historical Society” and how the court works. I printed it off and will scan and post if you think it will help. Not sure his blog is operating today.
