I guess in the trade this sort of thing is called a slap suit. The idea is for the well off to wield the court system as a punishment tool wherein the cost to defend is as damaging as any real judgement.

You can burn a national flag, trample any sysmbol you wish, but to parody a widely know photgraph by utilizing it in unpaid commentary on a not-for-profit discussion website is soemthing that the Fist Amendment to our Constitution can't defend, (unless you are a leftist.)

I agree that this is serious. Liberal groups habitually sue to quash conservative speech. John O'Neill of Swift-Boat fame knows this first hand.

I'm not a lawyer, but if Light appropriated your Kerry parody for his own financial benefit--without your permission, you may have grounds for a countersuit. It would appear to me that much depends on how the law views copyright protections for your creations. At a minimum, I would hope the courts would recognize your right to free political speech and would award compensation for legal fees to you. Freepers who are lawyers will be able to advise if this makes sense.
