Rudy (Giuliani) On Judges

Given the more liberal tendencies of Rudy Giuliani on abortion and guns, conservatives have expressed serious misgivings about his run for the nomination. However, the main effect that a President can have on these issues involves his or her outlook on the judiciary. The federal court system has been the main battleground for both issues, with Roe specifically precluding any kind of legislative action. Court nominations have become one of the essential considerations for presidential contenders -- and it may be more important for Giuliani than any other Republican candidate.

Giuliani has hinted that he would nominate jurists in the mold of Antonin Scalia and John Roberts. Today, at a visit with the South Carolina GOP Executive Committee, an audience member pressed him for his position. His campaign office has supplied us with the transcript of his answer:

On the Federal judiciary I would want judges who are strict constructionists because I am. I'm a lawyer. I've argued cases in the Supreme Court. I've argued cases in the Court of Appeals in different parts of the country. I have a very, very strong view that for this country to work, for our freedoms to be protected, judges have to interpret not invent the Constitution. Otherwise you end up, when judges invent the constitution, with your liberties being hurt. Because legislatures get to make those decisions and the legislature in South Carolina might make that decision one way and the legislature in California a different one. And that's part of our freedom and when that's taken away from you that's terrible.

It sounds as if Rudy has what could be an unbeatable combination. His personal views trend to the center and perhaps even liberal on these issues -- but he wants to nominate jurists that will return these questions to the...

You do realize the same MSM that has no problem bashing the President, the WoT, the Battle of Iraq, panders to left wing nuts as 'military specialists' is foisting Rudy on you as THE candidate to win the GOP nomination?

The Rudybots need to wake up. Rudy, makes a better Democrat candidate that Hillary.

Hey - I'm the last person to defend Rudy's past social liberalism.

However, I looked at Rudy's record, and his fiscal & national security conservatism, his taking on the welfare state and out-of-wedlock births, his executive experience running America's largest city, and that right there told me that this was more important than abortion/gay marriages/gun control, which he has very little control over and existed before him anyway.

Do you foresee someone overtaking Rudy at this point?

Even if all Rudy supporters on this site went over to someone else (who?) it's not going to help. People don't just change their natural pick because you want them to.

If you are going to overlook all the personal baggage that Rudy brings, marriage infidelity, his stances on abortion, guns, gays. Then I would prefer Newt. At least his views are totally conservative.

What he said or done in the past Giuliani is well aware of and will inenvitable move to the right on these issues.

The problem is that he's got miles and miles of room on his right. This is his statement to the press when he filed a frivolous lawsuit against gun manufacturers. This reads like a VPC tract...

New York City Sues Gun Industry
By Mayor Rudy Giuliani

On June 20th, I was pleased to announce that the City of New York filed a lawsuit against two dozen major gun manufacturers and distributors. This is an industry which profits from the suffering of innocent people. The lawsuit is intended to end the free pass that the gun industry has enjoyed for a very long time, which has resulted in too many avoidable deaths. The suit alleges a number of illegal practices on the part of the gun manufacturers, including:

  • Deliberately manufacturing many more firearms than can be bought for legitimate purposes such as hunting and law enforcement, and knowingly targeting these excess guns to criminals, youths and other persons unqualified to buy firearms;
  • Deliberately undermining New York City's gun control laws by flooding other markets which have less stringent gun laws with firearms that the manufacturers know are destined to be illegally resold in New York City;
  • Ignoring the illegal practices of gun distributors, many of whom openly engage in the above practices;
  • Refusing to manufacture safer guns, with features such as trigger locks and "personalization" measures that allow only authorized persons to fire the weapon.

More than 30,000 Americans each year - including 4,200 children - die because of gun violence. In addition, the city has found evidence of advertisements by gun manufacturers that claim their guns don't show fingerprints. This feature serves no purpose unless the user is intending to use the weapon for illegal purposes.

It is our hope that this suit will result in substantial financial awards to the City for the many ways in which illegal practices and illegal guns harm New Yorkers; including the $17 million dollars each year that are spent by the City's Health and Hospitals Corporation treating gun-shot wounds.

Over the past six years, New York City has reduced crime and murder more than any City in the nation. Our success has been built, in large part, on the tireless efforts of the Police Department to remove guns from our streets. But 95% of the guns that our police seize come from outside the City of New York. Their job of keeping New York safe is made considerably more difficult because of less restrictive guns laws in other parts of the nation and because of the illegal and immoral practices of the gun industry. This lawsuit is an aggressive step towards restoring accountability to an industry that profits from the suffering of others.

These aren't the words of a conservative.

Bush I was a faux Conservative, who didn't want to be bothered with judicial appointments. Reagan went with a former GOP elected official of whom everyone guaranteed would be a Conservative judge. She "grew" once nominated.

Rudy will nominate Liberals; there is simply nothing in his record, personal beliefs, legal judgment, or Mayoral tenure to suggest anything otherwise.

Rudy Giuliani will be the worst nightmare for Conservatives, ever. All his Liberal beliefs, and a more Liberal Supreme Court.

He's already lied about judges several times: first he said that John Roberts wouldn't have been his choice for Chief Justice - then he says that, looking back, he doesn't think he would have done anything differently than Bush. So which is it, Rudy?
