Given the more liberal tendencies of Rudy Giuliani on abortion and guns, conservatives have expressed serious misgivings about his run for the nomination. However, the main effect that a President can have on these issues involves his or her outlook on the judiciary. The federal court system has been the main battleground for both issues, with Roe specifically precluding any kind of legislative action. Court nominations have become one of the essential considerations for presidential contenders -- and it may be more important for Giuliani than any other Republican candidate.
Giuliani has hinted that he would nominate jurists in the mold of Antonin Scalia and John Roberts. Today, at a visit with the South Carolina GOP Executive Committee, an audience member pressed him for his position. His campaign office has supplied us with the transcript of his answer:
On the Federal judiciary I would want judges who are strict constructionists because I am. I'm a lawyer. I've argued cases in the Supreme Court. I've argued cases in the Court of Appeals in different parts of the country. I have a very, very strong view that for this country to work, for our freedoms to be protected, judges have to interpret not invent the Constitution. Otherwise you end up, when judges invent the constitution, with your liberties being hurt. Because legislatures get to make those decisions and the legislature in South Carolina might make that decision one way and the legislature in California a different one. And that's part of our freedom and when that's taken away from you that's terrible.

Ah, but the social-issue conservatives believe that the President can rule by decree and eliminate abortion, gay marriage, and nullify the 20,000+ existing gun-control laws overnight that preceded Rudy's two-terms as NYC mayor.

And Phi Kap Mom is right, the Supreme Court needs to simply remove itself from issues that don't involve interpeting the Constitution, nothing more. I think that Rudy will respect that in judicial appointment.s
Nope, but nice strawman. We simply believe that a known gungrabber (he SUED gun companies in a futile effort to hurt them) who was the SOLE candidate of the GOP to take money from NARAL and praise the murder of children is not a good choice for president.

I am already tired of him
As I said, he may have an "R" after his name, but he acts like a pro-war Democrat. As far as I can tell, his political views are roughly the same as Joe Lieberman and to the left of Dick Gephardt and possibly even to the left of Tom Daschle.
He and Hitlary have near identical positions. Since I am asking Spiff to post his chart, it certainly cannot be seen as "spam" and it does demonstrate why he is the "lesser of two liberals".

So much for all the naysayers spinning about him and judges but they will still keep spinning is my guess. They learned their lessons well from the Clintons! :)

His claim that he is a strict constructionist is ludicrous. How can anyone who supports Roe and McCain-Feingold and happily eviscerates the second amendment claim they are a "strict constructionist".
It changes. Spiff upgrades it, and in the rare case a Rudbot finds an error, he fixes it. I'd like to see the most recent version. Is that OK with you?

Giuliani's gambit is to assure us he will appoint strict constructionsts who will frustrate his social liberal tendencies and goals. "Elect me and I'll appoint judges who will protect you from me."
And his supporters are eating it up.

I have been saying this for a long time -- I want the feds out of issues thata belong in the states which is why I don't understand a lot of people on here that want the Congress to get involved. That's as bad as the liberals IMHO. Let the States decided in each state like they did the marriage between a man and a woman.
