US Supreme Court approves expanded hacking powers

The US Supreme Court has approved a rule change that could allow law enforcement to remotely search computers around the world.

Previously, magistrate judges could order searches only within the jurisdiction of their court, often limited to a few counties.

The US Department of Justice (DoJ) said the change was necessary to modernise the law for the digital age.

But digital rights groups say the move expands the FBI's hacking authority.

The DoJ wants judges to be able to issue remote search warrants for computers located anywhere that the United States claims jurisdiction, which could include other countries.

A remote search typically involves trying to access a suspect's computer over the internet to explore the data contained on it.

It has pushed for a change in the rules since 2013, arguing that criminals can mask their location and identity online making it difficult to determine which jurisdiction a computer is located in.

'Only mechanism available'

"Criminals now have ready access to sophisticated anonymising technologies to conceal their identity while they engage in crime over the internet," said DoJ spokesman Peter Carr.

"The use of remote searches is often the only mechanism available to law enforcement to identify and apprehend them.

"The amendment makes explicit that it does not change the traditional rules governing probable cause and notice."

It said the change would not give law enforcement any new authority not already permitted by law.

. . .

However, groups such as the American Civil Liberties Union (ACLU) have warned that the change could expand the FBI's ability to conduct mass hacks on computer networks.

…what part of that sentence doesn't scream "I can't wait to be abused!"?
About the only thing I can think of that would be more open to abuse would be Writs of Assistance.

That's not considering already extant procedures/'justifications' like "exigent circumstances".

Warrants will be issued, but I don't know how easily they are to obtain and if this law will be adhered to in light of the lawlessness of this administration.

As weird as it sounds, this can of worms only got more tangled. Nobody on the receiving jurisdiction of these searches has agreed to honor them. Some of this will fly in federal court, but is is doubtful that all jurisdictions even those within the US will agree on the meaning of the ruling.

The court needs to have it’s members tried for treason.

Totalitarian control-—how unconstitutional of the Marxists on the SCOTUS to throw out our “Justice” System for Stalin’s and Hitler’s.

BWTH, they have been doing it since they allowed the globalist cartel to set up the Federal Reserve to make slaves of all of us and control everything we see and hear in the “news” and control all our “judges” so that Tesla would lose his patents and they could make themselves filthy wealthy and insert themselves in the control of ALL property. The corp. cartels picks the winners and losers and the divide is getting really expansive now with their kids making millions an hour, and we have no Freedom of even what our own children “think”. Mandatory indoctrination centers-—now all-day kindergartens so the State can embed their unshakeable worldview in our children——cogs for the machine—who have all Virtue destroyed.

Oh Well,,,,,then they added a “Natural Right” to killing babies-—then, the killing of the Old (who had the Natural Right to suicide by doctors (lol) ....and then the “special” Natural Right” to sodomize others and force children and Christians to think the muslim/pagan/satanic ethics are “Good” and “Natural”. Flood all movies/TV with males kissing so our children will be as insane and ignorant of Truth/Natural Law as muslim harem boys.

All the above is removed from “Right Reason according to Natural Law” and so is unconstitutional. We have INDIVIDUAL NATURAL RIGHTS FROM GOD THAT ARE UNALIENABLE——and now we have a Big Brother that keeps track of ALL our ACTIONS and DICTATES Good and Evil based on Satanic Ethics. (Our Justice System-—based on the “..the Laws of Nature and nature’s God” is now a Vice (cartel) System of total slavery for the State.

I have a paper on that... and I personally think there are multiple treasons (actual as-defined-by-the-constitution treason) the USSC has perpetrated.

Whenever I encounter someone in favor of government snooping, I ask them:

Suppose your next door neighbor is an accountant for the IRS. Should he be able to– whenever he wants– read the texts you send to your wife? Should he be able to come to your house at will, and poke around in your bank statements? Read your emails? Look in your closets?

Because that’s who the government is. It’s peoples’ next door neighbors who have no business looking into anything in your life any more than you have business looking into theirs. We’re not talking about a two-way street; they don’t consider us their equal.

We need to be reminded that ‘the government’ is not some benevolent friend. It is people who couldn’t get a job in the real world, with unjustified power, acting in their own interest.

I may be in the minority. I believe that Snowden, Putin and Obama have the same agenda.

Court has this crazy notion that people outside it's jurisdiction will obey it's edicts... - ANDROID PING!

Android Ping!
If you want on or off the Android Ping List, Freepmail me.

My take on it: they're dreaming. A court would be lucky to find another jurisdiction in the US that would accede to it's ruling on a search warrant, let alone many international ones.

I'm also trying to wrap my head around the notion of a warrant regarding person X allows a search of person Y's property. You see, remote accounts etc. are stored on computer systems that the person does not own. Sets an odd precedent. If I have a friend in another State who ends up with a search warrant issued... Does that mean they could come to my house and search the book he lent me? Or my entire house looking for a slip of paper that may have fallen out?

The US Department of Justice (DoJ) said the change was necessary to modernise the law for the digital age.

If only there was a mechanism for 'modernise' law.. Let's see... Could it be through a process where an elected representative submits a bill, it is passed through a committee, debated, voted upon and passed to the senate which also reviews it through committee, debates it, optionally passes it and submits it to the president for his review and possible approval?

OH, silly me, instead it is just a change in court rules which are governed exclusively by the congressional branch. So of course, the judicial and executive can just meet together, talk about it, and make new rules as desired.

The issue is a no-brainer; courts were tossing out evidence obtained while discovering the location of a computer due to the warrant being issued by a magistrate who didn't have jurisdiction over the eventually discovered location. A court created problem which has now been 'solved' by a court created solution. Just doesn't happen to be their job, in either case.

The Supremes expanding their jurisdiction worldwide is what this sounds like to me.

Whats to stop the other 192 countries from expanding their courts’ jurisdictions worldwide as well?

Nose under the tent for things like asset seizure across national borders, and criminal convictions in jurisdictions where the accused never even set foot.

Erdogan is already trying to enforce Turkish law in foreign countries.

What a load of crap. They make Snowden out to be more than he was, a low level employee of a sub-contractor working for the NSA. . . What can I say, it's a movie Directed by Oliver Stone which means that if there is any truth in it, it's only in the Credits. . . and I'd suspect half of those as being false.
