According to the Obama administration, because Obama's mother was U.S. citizen and because he was reportedly born in Hawaii, he has the necessary qualifications to be President. But many, dubbed "birthers" by Obama supporters, still believe he was born in Kenya. If true, the argument goes, he would not be qualified to hold the Executive office because regardless of his mother's citizenship, he was not born on U.S. soil. The latter is a legitimate argument and one that appears to be supported by the Constitution, though no court has ever clearly defined the meaning of a "natural born citizen."
Republican Presidential candidate Ted Cruz has a similar problem as he was born in Canada. Unlike Senator John McCain, who was born on a U.S. military base in the Panama Canal Zone in 1936, Cruz was born in Canadian and on Canadian land.
Cruz argues that because his mother is a U.S. citizen, and because he had dual nationality and renounced his Canadian citizenship after he turned 18, qualifies as a natural born citizen.
But according to a report from Karl Denninger at The Market Ticker, Canadian law in 1970 when Cruz was born makes it clear that no such dual nationality existed at the time, making it impossible for Cruz to have been a Canadian citizen AND a U.S. citizen at the same time:
There's a clean question on the table regarding dual citizenship for persons born in Canada prior to 1977 (when they changed their law to officially recognize dual nationality.)
Prior to that date, with few exceptions, you could not hold dual nationality with Canada. In other words the very act of "renouncing" Canadian Citizenship means that Cruz never held US citizenship at birth because his parents had to declare his nationality at the time he was born.

Or one of America’s founding fathers. Get this thing litigated NOW and a Congressional or Supreme Court ruling forever more. Why is Cruz dragging his feet on this? I suspect because it could go either way, and he’s unwilling to take the risk.

If it was me, I'd be out there touting the applicable law or court cases that prove I'm a natural born citizen. Cruz is a Constitutional scholar, like Obama, where is he on this?
And a naturalized citizen cannot be President or V.P.
A law like that (conferring citizenship on everyone born in the Congo REGARDLESS OF THEIR PARENTS CITIZENSHIP) already exists for the Virgin Islands.

A very good argument can be made to the effect that the document that you seek, a consulate certificate, does not create either the citizenship or the natural born citizenship but merely documents that citizenship and natural born status. If so, and no certificate was issued to a child who was otherwise qualified, that child is nevertheless a natural born citizen by right and can obtain the certificate and any time.
Finally, the idea that Cruz can go into court for a declaratory judgment is simply wrong. The courts will not issue a declaratory judgment in a political situation.
He is eligible to be a U.S. Senator even if he is a naturalized citizen. The problem is, some say he cannot prove his mother registered him as a U.S. citizen at the American Consulate after birth, and Ted C. doesn’t have the necessary documentation proving same, and an American passport to enter the U.S. when he was 4. Then since he renounced his Canadian citizenship less than 2 yrs. ago, some believe he is a “man without a country”, and not an American citizen at all. Everyone has a varying opinion of all the “black marks” against him and Ted C. has done little to clear the air other than his birth certificate and his mother’s birth certificate.
Yes. I guess my point is that citizenship at birth is meaningless with regard to natural born citizenship. We still have people here who think that any citizen can be president. So we’re still pushing the basics. The real shame is the Cruz the Constitutionalist is the penultimate hypocrite on this fundamental issue.

I think the onus is on Cruz to prove it before he takes us all down the yellow brick road. He would make a great President, but if he is ineligible, and attains the Presidency, it would set a legal precedent for others not so “great” to run for the Presidency after.

Cruz’ mother who was a citizen of the United States when Cruz was born has actually produced Ted’s birth certificate. Based on that and the law, Ted is a natural born citizen.

Cruz is a ‘natural born’ Canadian. He will never be a ‘natural born’ US citizen... and Cruz knows this, as any Harvard Law Schooled grad knows... Lawyers live to change the law... But lawyers nor judges can give or take ‘birthrights’.
