Justice Department special counsel Robert Hur has training in neither psychiatry nor neurology, yet he included an assessment of President Biden's cognitive functioning in his report declining to bring charges for mishandling classified information.

Memory assessment is a complex task and cannot be undertaken over five hours in interviews with attorneys.

I didn’t read the entire report but from what I read in news reports, Hur didn’t really diagnose anything. He seemed to just report his observations and excerpt transcripts from the deposition, which was “Biden couldn’t recall this or that”. That is exactly what lawyers do. They take their evidence and put it before the courts in pleadings. This has nothing to do with psychiatry diagnoses.

As for a prosecutors, they have to make a separate determination whether a prosecution is likely to be successful. They have to consider the evidence and crimes to be charged if any based on the evidence, and consider what the defense might bring up in trial or pretrial hearings which might include expert testimony from a psychiatrist attesting to cognitive abilities and the like.

So I am not sure what this author is driving at - just a knee jerk reaction in defense of the POTUS that is not relevant to the matter.

Does he also propose that mentally deficient defenses should not be allowed in determining guilt or innocence in a criminal proceeding? Do you think for one moment that Biden’s lawyers would not raise that defense?

Actually, Dr. Sidney Weissman, MD - Psychiatry Specialist in Chicago, IL • Age 84, was feeling insulted. I’ll bet he has lapses of memory as he has over 58 years of questionable experience in the medical field.
