Donald Trump said on Friday that he does not plan to declare a national emergency – a day after suggesting he would “probably” do so.
Speaking at a cabinet meeting over the government shutdown and the border wall, Trump said: “What we’re not looking to do right now is national emergency.”
The president instead urged Democrats to “come back and vote” in Congress in a bid to end the government shutdown.
Trump insisted he had the right to declare an emergency, but said: “I’m not going to do it so fast”, according to a White House pool reporter.

A defeat that, with enough resolve, could destroy the Democrat Party as we have come to know it for all time.
Best case is congress passes funding without border wall. Trump vetoes the bill. They override the veto. THEN he declares national emergency and builds the wall.
This is not a concession by Democrats. It is theatre, it is tap dancing. They will never allow meaningful barriers to illegal immigration. Never.
Not when it's an executive process requiring a formal declaration.
The Democrats in the House have voted to end the shutdown by passing funding bills that don't include wall funding. He's in danger of losing enough Republicans in the Senate who will vote for those bills if McConnell would allow them to be voted on.

MEXICO CITY — Another migrant caravan is forming in Honduras, with plans to set out next week on a journey that will once again test the immigration policies of Mexico and the United States.

Correct. A President can issue a formal declaration confirming that a national emergency exists. But that’s not what Trump said. Trump discussed “doing” a national emergency. A President doesn’t “do” an emergency. The emergency either exists or it doesn’t.

He shouldn’t have said he won’t do it. He should have said it’s still on the table.
