‘You should have died in the Holocaust’: Neo-Nazi harassment is not free speech, judge rules

A caller said: “You should have died in the Holocaust with the rest of your people.”

But the calls that most disturbed Tanya Gersh consisted only of the sound of gunshots being fired.

The terror campaign — known as a “troll storm” — was the result of Daily Stormer publisher Andrew Anglin’s December 2016 directive, urging hundreds of thousands of readers to harass the Jewish woman and her family, according to court filings.

Gersh sued the known neo-Nazi. On Wednesday, a Montana federal judge denied Anglin’s motion to dismiss the case, holding that speech in encouraging anti-Semitic harassment was not entitled to First Amendment protection.

The Montana mother found herself in Anglin’s crosshairs in late 2016, after Richard Spencer, a household name in the alt-right movement, gained notoriety when a video of him shouting “Hail Trump!” at a conference of nearly 300 white nationalists — and the Nazi salutes it elicited — went viral.

Spencer’s mother, Sherry Spencer, owned a ski home in the otherwise idyllic town of Whitefish, Mont. After facing local protests related to her son’s views, she reached out to Gersh, who in 2016 worked as a real estate agent, about selling the property.

Subsequently, court filings allege, Sherry Spencer decided not to sell. Months later, she published a blog post on Medium, accusing Gersh of extortion, threats and denouncing her son’s views.

The next day, Anglin called his own readers to action.

“Are y’all ready for an old fashioned Troll Storm?” Anglin wrote in a Dec. 16, 2016, post on the Daily Stormer website...

The LGBTQ people went to court and got the names of everybody who donated to the Prop 8 cause in California then proceeded to harass their workplaces and businesses until they were fired or shut down.

The courts approved of this behavior and doxxing under the auspices of free speech and private enterprise and continue to do so. Unless, of course, you’re a Christian bakery or pizza place.

Fighting words are free speech. Outright threats are not - but these are not (read the examples - you should, you need to be - not you will or I will )

Otherwise the very words “he needs to be tarred and feathered” should land me and us in prison and banned from the internet.

And YET being banned from the internet, fired from your work, denied accesss to banks because of your words is approved actions by the left.

You can't preserve freedom of expression and freedom of association if you carve out exceptions for speech that you feel is vile or offensive.

Um, I see the Washington Post left out a few key details.

For starters, the protests were organized by Gersh herself who then kindly offered to buy Spencer's property for significantly under market value.

Exactly, it was a disgusting shakedown attempt and Anglin retaliated and Gersh cried to law enforcement because someone dared to stand up to her.

You may not like the Daily Stormer, I personally don’t, but this is an attempt to essentially make it illegal to fight back against Antifa.

Im sure threatening someone isn’t considered “freedom of speech” the fact that the person was a Neo-Nazi has nothing to do with it really.

The call to harass was definitely criminal.

Judges should also apply this law to harassment of un-favored political beliefs.

However, it is still legal to harass another for their political beliefs. It appears even severe harassment, threatened and actual violence against some political beliefs is still OK according to law.

Keep that in mind.

Are Semites the only protected class here? We are constantly treated to anti-white remarks from “entertainers” and college professors. Nazi salutes are counterproductive. That is why people who do this are most likely agents provocateur.

There was a time when the norms of civility were such Anglin’s hateful words and actions would be seen as totally looney and worthy of simple scorn. But now, the extremists, mainly the left, have destroyed decorum, leaving it up to courts to rule. Left to itself, the government will always rule in favor of suppression of free speech.

It will get reversed on appeal.

The Supreme Court held that the Westboro Baptist Church has a Constitutional right to hold “Thank God for dead soldiers” protests at the funerals of soldiers killed in Iraq. Pretty much anything is fair game.

Whites will never be a protected class because of garbage like “white privilege”. Even in 2060 where whites are a minority in the US, I guarantee you they will not get the same legal protections under current “Civil Rights” laws.

No right is absolute and inciting people to terrorize someone is clearly beyond the pale.

How does one incite people to do anything? Nobody,no matter how convincing,could convince me to do something like this.Of course communicating a treat to another,even if you have no intention to carry it out,is a crime...and *should* be a crime.I don't know if that's a factor here (I didn't read the entire piece).

Is stuff like this,even when assuming that no violence or threats of violence occurred,disgusting? Of course it is.But so is the Rat Party having officially declared those like me to be "deplorable","dregs",etc.
