I’m not sure that’s what Comey said. He is telling DOJ to put up or shut up, KNOWING they can’t put up evidence without revealing the FISAs that will expose them.
And has reported to Trump about the NSA surveillance of Trump Tower.

REALITY CHECK---It is entirely possible Obama and his legal team may have perjured themselves before the FISA court by willfully withholding material information in order to manipulate the FISA court’s willingness to permit the government surveillance.
This would fall under the Crimes Act of 1958.
FALSIFYING GOVT DOCUMENTS---falsifying official documents is the criminal MO to hide larger crimes.
A person falsifying documents can be held criminally liable if they are deliberately acting with the intention of deceiving or defrauding another party.
Falsifying documents is a very serious offense and is generally classified as a felony. This means that a person charged with falsifying documents may be subject to the following legal penalties:
◾Having to pay a monetary fine
◾Incarceration in a prison facility
Depending on the gravity of the offense, as well as individual state laws, falsifying documents can result in a prison sentence of 5-10 years.
Also, if official government documents or govt authorities were involved, the legal penalties may be more severe. Legal penalties may increase with repeat offenses.
Many different types of acts can be considered as falsifying a document, including:
◾Altering or misrepresenting fact-based information
◾Stating false information when requested to provide truthful statements
◾Forging a signature
◾Using official letterheads without authorization

As I understand it, the President has the authority to initiate surveillance outside of the FISA process.
If that is the case, then perhaps the FBI wasn’t involved at all. That may be what Comey is getting at.
Well under FISA snothing can be done without her signoff. Nothing.
So at this point her only defense is to cry havoc and let slip the dogs of war - except those dogs are rather fat and lazy and long in the tooth.

Remember the initial request was rejected. So there was no there, there. The second request was for a computer only...so it was said.
The thing is, Obama could have approved the original surveillance while the FISA redo was underway.
The entire thing was all about getting Obama out of office ‘unscathed’...and Hillary from ‘facing charges’ by distraction and diversion..... They’re both out now...so for the Demorats that’s a success...protecting their political assets.
