Abortion-rights activists won a major victory yesterday when a federal appeals court agreed that a New Jersey law banning late-term abortions is unconstitutional.
The ruling by a three-judge panel of the 3rd U.S. Circuit Court of Appeals upheld the decision of a Trenton federal judge who struck down the law in 1998.
“You can’t ask for better,” said Talcott Camp, a lawyer for Planned Parenthood, which joined the ACLU in challenging the law.
“Doctors’ constitutional rights and women’s health is protected in New Jersey.”
ACLU state legal director Lenora Lapidus also hailed the ruling.
“We are gratified by the 3rd Circuit’s decision. We were confident all along that the district court had correctly held that this statute was unconstitutional,” she said.
Writing for the panel, which sits in Newark, Circuit Judge Maryanne Trump Barry noted that on June 28 the Supreme Court struck down a Nebraska law aimed at banning partial-birth abortions.

The ruling is a defeat for state Republican leaders who enacted the measure over a veto from Gov. Christie Whitman and used more than $400,000 in taxpayer money to defend it in court.

This was however in 2000. Seems that the Supreme Court addressed the issue in 2006 and upheld the ban after multiple states found such bans unconstitutinal NJ being one.
