what would you do? (vanity)

You park your SUV in a space and you and your wife prepare to do some shopping. You open the door and a 300 pound jerk is near to the vehicle and he slams your door shut and yells at you and tells you to leave, and says your kind don't belong around here. You get out of the vehicle, and the jerk pushes you back into it, punches you in the face a few times, and for good measure, punches your wife in the mouth, splitting her lip. He walks away and you get out of your car, and you have your concealed weapon in hand. The jerk is about 35 feet away. He sees you and angrily yells that he told to leave and he's going to f... you up! He charges at you, and you only have a couple of seconds to decide. What would YOU do?

De-escalate. ID the guy as best you’re able, remove yourself from the situation and file a report. He’s already walked away. You’re going to jail if you shoot him. The defensible time for lethal response was during the assault. After the fact would be perceived as vigilantism.

Kick to the groin, elbow to the back of the neck as he doubles over.
Then get his wallet and any jewelry.
Maybe shoes, too .. if they look like they’ll fit.

I don’t see why cops would laugh. They carry with the safety on and one in the chamber as a matter of training. In your case, you are making a conscious choice for an extra level of safety. It could cost you your life in a split second situation, or save your life or the life of another if someone grabbed your gun and you were able to drop the clip before the guy could fire. But it is not a WRONG way to carry.

It’s too late to de-escalate. He is coming back for more. I normally would agree with you, but he’s withing the zone...even if there was time to get back in your vehicle, how do you know he’s not gonna beat the smack out of your car, open the door, and beat on you some more?

How do you de-escalate when he bum-rushing you while yelling at you he is going to f*** you up?

Scenario as described has the assailant walking away. Too late. If he returns and assaults you again before you’re able to remove yourself from the situation, then lethal response once again becomes defensible.

Car doors have locks. Situation as described asks what one would do with an assailant walking away after assaulting yourself and your wife. Walking away. That is very problematic from a legal standpoint and if you do not keep your wits about you, you are the one going to jail.

The hypothetical failed to mention WHERE the incident occurred. In New York one would have to submit to whatever the 300 pounder wanted to dish out; i.e death or injury and/or rape of the wife.(Especially if he was black.) In a sane state one could shoot the clown
