SALT LAKE CITY (AP) - A federal judge has allowed gay marriage in Utah to continue.
Judge Richard Shelby on Monday denied a request by the state that sought to halt gay marriage until the appeals process plays out.
The same judge overturned Utah's ban on same-sex marriage Friday, ruling it is unconstitutional.

Yup. After Prop 8 we knew which way things were going.
i guess the heartland will have to keep electing DEMs and we all can continue to be ruled by the federal judiciary ...
if there a new strategy memo about the senate races in: AK, AR MT, LA, SD, NC, etc.?
The commenters on here seem to think we need to stand down and ride on my horse until orders come in from headquarters. Because of this US District Court Judge Shelby
I saw no one say to stand down. However you suggested that they read. They’d prefer a Constitutional course of action.
well, that is great Mac.
Let me know when you get that course of action.
Have a nice evening.
Motioning for a stay to the same Judge Shelby who had just ruled the Utah state statute unconstitutional was merely a procedural maneuver by the State of Utah. You didn’t have to be a rocket scientist to predict today’s ruling.
Now the motion for a stay will go to the Tenth Circuit in Denver. Wouldn’t be surprised if the stay were granted and the flow of exultant gays and lesbians to the marriage license bureaucracy (which must rankle the majority of the local population) shut down, at least temporarily.
It wasn’t a surprise. As I understand it, it’s only one clerk issuing licenses and not the whole state.
snark? this is a snark thread!
things to do:
1. Convince the voters in UTAH to vote that bad judge out of office and replace him with a Contitutionalist!
2. Git the sheriff to arrest him.
Snarky is as snarky does ...
I’m anti-sedition, pro-secession, so maybe that is why I look out of place on my horse shouting “Cavalry No!”
So you're just being snarky, I assume, because he's a federal judge and therefore, regrettably, can't be voted out of office. The only ways he can possibly leave office are by death, resignation, or impeachment.
States can’t remove federal judges, they should ignore them, do not abide by their rulings
The peopl in Utah the state officials need to take action against the Feds they need to stand up and say: NO. The state government needs to say no.
Would such a stay render any licenses given null and void?
Also, I’ve another question. The state AG enforces marriage-related employment laws, correct? Can they simply declare to companies in Utah that they will not pursue any action against companies who refuse to recognize it. That essentially renders the ‘marriage’ pointless anyway, since these people are looking for employments perks.
The states definitely need to stand up to federal government. They created it and let it become a monster.
It’s a travesty if a state like Utah does not tell the feds to shove it. Let Obama send in the national guard or whatever. That will look good on his tyrant resume.
The thing is, after Reid’s rule change precedent, should we control the chamber, we can impeach with just over 50.
Who appoints the clerks in these counties? I can’t believe many who support this ruling have gotten into clerk jobs.
County clerks around here are voted into office. I haven’t looked into the clerk who is issuing licenses.
