A 30-year-old man was sentenced to six months in prison on Monday, December 21, 2020 for the sexual assault of a schoolgirl in Saint-Nazaire (Loire-Atlantique).

The suspect was quickly apprehended.

This man of Afghan nationality, father of a family, made confused remarks during his custody, denying any sexual act, and speaking rather of "paternal tenderness".

A psychiatric assessment, carried out before the trial, concluded that "a moderate impairment of discernment".

"He couldn't ignore her refusal"

For prosecutor Margaux Raoul, the evil intention is not in doubt:

For the defense, M e Marie Chedru described a man "completely lost, with visible psychiatric disorders", who came to France by his own means, "after having suffered torture in his country".

This asylum seeker, unsuccessful at first instance, was not present at the hearing.

It will also be registered on the File of perpetrators of sexual offenses (Fijais).

Present in the room, the mother of the victim said that her daughter was not suffering from trauma "but was very afraid at the time".

Les faits remontent à l’après-midi du mardi 3 novembre 2020, aux abords de la place Poincaré.

La victime âgée de 15 ans rentrait à pied chez elle après sa journée de cours quand elle a été abordée par deux hommes.

L’un d’eux, alcoolisé, l’a attrapé par le bras avant de lui arracher son masque.

Il l’a embrassé une dizaine de fois sur le côté du visage avant de lui lécher la joue.

En se débattant, l’adolescente a pu se dégager de son emprise, avant d’être prise en charge par des passants qui ont appelé la police.

Le suspect a été rapidement appréhendé.

Cet homme de nationalité afghane, père de famille, a tenu des propos confus lors de sa garde à vue, niant tout acte sexuel, et parlant plutôt de « tendresse paternelle ».

Une expertise psychiatrique, diligentée avant le procès, a conclu à « une altération modérée du discernement ».

« Il ne pouvait pas ignorer son refus » Pour la procureure Margaux Raoul, l’intention délictuelle ne fait pas de doute :

e demandeur d’asile, débouté en première instance, n’était pas présent à l’audience.

Il sera également inscrit sur le Fichier des auteurs d’infractions sexuelles (Fijais).

Présente dans la salle, la maman de la victime a indiqué que sa fille ne souffrait pas de traumatisme « mais avait eu très peur sur le moment ».

Now that’s a new defense, “paternal tenderness”. My guess is his lawyer came up with it.
