Calling for the murder of Jews in America for what Israel may have done is not protected by the First Amendment.

Of course, imams and mullahs all over the world scream “death to the Jews!” every day, so Mossad would have their plate full trying to take them all out.

I know of no Catholics who see this pope or any pope as being above reproach or questioning. No one is sinless. That said the world is full of snakes of every stripe and you can no more associate the sins of any clergy with the message of the Church than you can indict all Christendom for the sins of Hitler and Stalin who were nominally Christian.

That’s the fine line though, and to be honest I’m pretty sick of sensationalism coming from the right nearly as much as the left. He isn’t calling for Jews to be killed, he’s saying “if x, don’t be surprised when y”, and “if it’s okay for x, why is it not okay for y”. He never said “because x, you should y”. He’s making what most would consider a false assertion and a false equivalence and asking rhetorical questions based on that, but not calling for action.

I wouldn’t call his words incitement, because no imminent lawless action is likely to occur from old man yelling at clouds, and there’s no way to prove he intends lawless action to result since again, he didn’t didn’t actually call for anyone to be killed. A true threat? No, he’s not threatening to do anything. Fighting words? I don’t see this guy’s video inciting an immediate breach of the peace. Do his words by their very utterance inflict injury? Maybe, but against who precisely? American Jews, Israelis, Synagogue goers, all of the above? American Jews vs. old man yelling at clouds doesn’t seem likely to come to a court near you. And I would add that I think the last is a very dangerous test these days, considering that there are people who firmly believe that someone accidentally not using their preferred “ze,zed,zur” pronouns inflicts injury.

In any event, if he broke the law he should be processed through the American justice system, not murdered by foreign agents.
