What is he going to sue them for, his own breach of contract? Saying that he should sue BYU is as ridiculous as saying someone who signs up for the military should be able to sue the military if they are dishonorably discharged for a violation of military rules.
Just because the signer of a contract doesn’t have the integrity to fulfill his obligations does not mean that the other party is equally bound to dishonor the contract.
Paying tithing is one of the de facto requirements of attending the university. Also, his tuition is subsidized by the tithing of other members of the church. This makes it an affordable private university. If tithes of the church were not used to subsidize his education there, he probably would not have been able to afford it in the first place.

You guys are cracking me up! What penny? The whole point if the church's position was that he had NOT paid tithing for 6 years, he didn't attend his meetings, didn't wear his temple garments, and didn't abide by the standards of the church, or BYU, and DID make a gay beefcake calendar trying to put LDS missionaries is a gay light. The Church was right to do what it did, so was BYU.
