Either McClintock or Schwarzenegger Likely Winner in California if Other Dropped Out
Most of vote for one candidate would go to other

GALLUP NEWS SERVICE
PRINCETON, NJ -- With Arnold Schwarzenegger the Republican front-runner in the California gubernatorial contest, many GOP officials have pressured California State Sen. Tom McClintock to drop out of the race, fearing he will divide the Republican vote and allow Democratic Lt. Gov. Cruz Bustamante to win. A CNN/USA Today/Gallup poll, conducted over the past weekend, shows that McClintock does indeed draw support away from Schwarzenegger, though not enough to deprive the actor of the lead. But the poll also shows that if Schwarzenegger were not in the race, McClintock would likely be in first place by a substantial margin rather than behind Bustamante....

DELANO, Calif. -- In this farm town and others along Highway 99 in California's vast Central Valley, they say his name as if it were a political battle cry.
"Bustamante!" exclaimed Maria Munoz outside the travel agency where she works. "He is the only one to vote for, no one else. He thinks like us." ....

SACRAMENTO No one is quite sure when or how it happened, but there is a growing sense among analysts Monday that Gov. Gray Davis' drive to defeat the recall has lost momentum.
Some blame the court case that interrupted the campaign last week at a critical point....

Bustamante says he may be able to retrieve some questionable cash

FRESNO, Calif. --
Lt. Gov. Cruz Bustamante may return just a small fraction of $3.8 million a judge ordered him to "make a good faith effort" to retrieve from television stations for air time on ads fighting a ballot measure, according to court documents filed Monday.
The amended order Friday from Sacramento County Superior Court Judge Loren McMaster ordering Bustamante to attempt to get refunds from television stations came just four days after the judge ruled Bustamante had to stop using a campaign finance loophole to collect money in an old campaign committee account and to return any such funds still in his possession.
At question is $3.8 million Bustamante received from Indian tribes and unions....

Pundits Reserve Judgment on Schwarzenegger's Jump in Poll

Robert B. Bluey Staff Writer
(CNSNews.com) - Despite surging ahead of other recall candidates in a Gallup poll released over the weekend, political analysts said Monday that Republican actor Arnold Schwarzenegger shouldn't get too excited as the campaign heads into its final week.
Absent other polls showing similar results, pundits said they would rather take a wait-and-see approach than jump to any firm conclusions based on the Gallup survey conducted last week after a debate among the top recall candidates....

If a majority of the votes in a recall proposal are 'Yes,' the officer sought to be recalled shall be removed from office upon qualification of his successor.
-- Elections Code, Section 11384
For all the buzz about the recall, very little has been written or said about what happens the day after the election.
For starters, nothing officially happens on Oct. 8.
It will take several days or even weeks for elections officials to tally all the late-arriving absentee ballots that arrive in the mail on election day or are dropped off by voters at polling places. Also to be reviewed and possibly counted well after Election Day will be provisional ballots -- those cast by voters who arrive at a polling place but whose names are not on the official list of qualified voters. They are allowed to vote provisionally, but their ballots are set aside for later review....

There is new controversy surrounding recall candidate Cruz Bustamante and Indian gaming money.
A federal judge last week ordered the lieutenant governor to return the money he raised from tribes around the state, because they surpassed campaign contribution limits.
Now, comes word that the general manager of the Big Sandy Rancheria Casino is Andrew Bustamante, his younger brother....
