Ok, Im confused and a little scared! Is it Ok if I just hang up on telemarketers, or do I have to listen to the whole sales pitch? I sure wouldn't want to go agin' the law!

Say you then that all "social interaction" is commerce?

That's a second definition which serves my point in post #155

I guess that puts you in your place.

So every case of a judge blocking a law is legislating from the bench? Does it matter whether the decision is a conservative or liberal one?

"What if CNN turned your TV on and forced your TV to turn to their Channel? There is a difference in speech here."

You mean the cold callers are now plugging phones in and turning them one? That’s outrageous!

Time to rephrase Shakespeare:

"First, shoot all the JUDGES"

Well my family has a right to be LEFT ALONE , especially during dinner.

Not really, no. I'm guessing that you'd be in favor of laws preventing Mormons and Jehovah's Witnesses from knocking on your door then, since you have the God-given, enumerated Constitutional right to not be bothered while watching TV on Saturday afternoons.

Your point that you arbitrarly claim one definition over another? Silence can be a virtue. In a quiet place you may be able to start reading up on Liberty and Commerce. The Federalist Papers -- even the anti-Federalist Papers.

The "blessings of Liberty" that's pretty much commerce in the sense of the times the Constitution was written.

I didn't say anything about CNN plugging in your TV - no relevance BUT telemarkerters do have to dial your number to activate a ringing tone and they leave misleading phone numbers on the caller ID causing you to answer your phone out of necessity in case it's an important call. And here's another difference: phones are a necessity much like power and water, televisions are not. It's also an interuptance to have an incoming call much like if there were business that could make money off of causing an interuptance in your power or water.

I just realized after reading this thread that there are as many whiny pussies of the conservative kind as there are of the liberal kind.

Sweet jeebus, just do what I do and get a phone with caller ID and never pick up from anyone calling from an unknown number. Haven't picked up a call from a telemarketer in over a year.

Actually, I DO resent evangelists.

I'm not a Christian, and I have no interest in what they are selling. However I am polite to them so long as they are not pushy.

Generally, I have better things to do than watch TV.

Is just me or was the First Amendment protection only intended for political speech?

I think you're right. That was considered the most threatened and tenuous speech at the time.

And all it meant is that you can't toss some bloke in the pokey for griping about the local commissar. It never meant that the government couldn't take measures to help neighbors who wanted to sleep not to hear his loud and annoying invective.

Now that federal judges are showing that they have the ultimate power, they are the ones most worth bribing.

I still remember something that John Kasich (who I am no fan of, btw) said to three IRS commisioners when he was chairman of the house budget committee. One of the IRS goons said in response to some of their heavy handed tactics in collecting taxes, that "Fear is an essential componant of a voluntary tax system." Hasich told them "Look, the American people son't like me very much." (all 3 nodded in agreement) "But they hate you. More importantly, they're afraid of you, and they usually do a pretty good job of getting rid of things that scare them."

Someone needs to explain to some of these whack-job robed thugs that fear and hate are building regarding them.

Isn't that what "no trespassing signs" are for or has that been ruled unconstitutional too?

If instead of phoning me at 8:00pm they stood outside my window and called into my home, would that be any different?

At least then you could shoot them with some rock-salt shells!

Legally!

Your point that you arbitrarly claim one definition over another?

So you assume regulating sex is what James Madison meant? Can we have some common sense with that cynicism as well? There are three defintions in that link... and you choose?
