The Ninth Circuit is a wild-hair Court generally, not just on this particular three-judge panel. If it were my choice, I'd take it straight to the Supremes and not bother with asking all the 36 (is it?) judges of the Ninth Circuit to confer by telephone. There is no requirement that parties to the case go to the whole Circuit (
en banc) before asking the SCOTUS for Emergency Relief.

I even got a booklet mailed to me a week before the 2002 elections in Georgia entitled "Voting Instructions". It was about eight pages long and showed pictures and a lengthy write-up (in English and Spanish for the illegals) about how one takes a "stylet" and punches a hole through the ballot.
I did manage to get through the process successfully!

Well, Clinton can have a school named after him. It isn't exactly an aircraft carrier, is it?
Myself, I think that we should file a lawsuit against naming the school. Makes as much sense as any of this.

Yes, they CAN stop an election. But the Supreme Court CAN stop, and frequently HAS stopped, the Ninth Circuit.

mwll, I know that...I teach US constitution (am administera US Gov't test as I write), I was referring to jurisidiction as far as the fact that this is a STATE election. I think they are using VRA (Voting Rights Act) and FEC rules to jawbone a reason to get involved. Agree with Billybob that SCOTUS is likely to slap them down. again.

However, I think odds favor the Supreme Court not wading into the morass at all. From their perspective, this is the sort of one-time circumstance which doesn't require the establishment of enduring precedent. Yeah, we might think it's imperative that the recall take place in October rather than March, but in the grand scheme of things, it's a rather trivial distinction in the nation's history. It might be if the time frame that should have precluded the March date were not enshrined in the California constitution, and if the first court that decided in this manner were a state court instead of a federal one.
In short, I think the SCOTUS will not see fit to intervene over such an incidental point of law, when the underlying principles [voting machinery and equal standards] are still in a state of flux. I could very well be proven wrong...
For the sake of California, I certainly hope so.

Especially with the Clinton's involved.
