Okay, a little voice told me to put up this thread...
Since I heard Sen. McClintock explain this plan twice in two days, during two different radio station interviews, I thought it would be a good idea to synopsis it. (I think is an excellent idea.)
As we have all pretty much figured, the way to do something about the passage of the illegal alien driver's license law, which will be signed any moment by our traitorous, corrupt governor, lies in our "ruby slippers," our wonderful referendum process. According to McClintock, the California Republican Assembly (a group which endorsed him, and the largest of its kind in California), already is buzzing about a plan to challenge the new law "once Davis's pen hits the paper." I have already checked their website and found nothing as of yet; however, McClintock says as soon as he has more information it will be linked on his website. (Let's keep watching for this.)
Here's how it would work. Signatures on petitions would be gathered as with the recall; however, the good news is that he said only a relatively small number would be required. (Off the top of his head, McClintock didn't know the exact amount, but he thought only about 1/4 or 1/5 the amount required for the recall. It should be a lead pipe cinch to get this on this one, IMHO.)
Of course, the signatures need to be collected in the proper, legal manner - I don't have the details to post at this time, but we can get that info readily - and then appropriately forwarded. The good news, according to Sen. McClintock, is that as soon as they are collected and forwarded as required by law, this ridiculous new law MUST BE IMMEDIATELY STAYED UNTIL THE NEXT SCHEDULED ELECTION. That would be MARCH 2004 if we can get the signatures quickly enough. And remember, this idiotic law doesn't go into effect until Jan. 1, 2004. Wouldn't it be wonderful if we could beat it to the punch entirely? Does anyone seriously have any doubts we'd knock this thing out in a referendum election?
Another thing, he mentioned that the CA Republican Assembly is not only talking about a referendum, but a possible lawsuit. He didn't give any more detail than that, though...this is all just at the beginning stages, naturally.
Anyway, I thought we could all use a little hope and a positive outlet for our righteous anger. We need to stick together and work positively to show these idiots that this is still OUR STATE, not theirs!

File a lawsuit to keep the liscense law in abeyance until the referendum process is over. I kind of got the sense that's another thing Tom was hinting at when he said the Calif Repub Assembly might ALSO pursue a lawsuit. At least I hope so.

Talking Points
- The federal government cannot protect homeland security as long as states are issuing driver's licenses to individuals whom virtually nothing is known about except the fact that they have broken U.S. immigration law.
- The 19 September 11 hijackers possessed 63 state driver's licenses that they used to facilitate their terrorist activities. States that issue driver's licenses to illegal aliens imperil the entire country by giving potential terrorists access to documents that make it easier for them to implement their plans to attack our nation.
- A driver's license is a "breeder" document. It assists the bearer in securing employment, registering to vote, transacting financial business, and boarding an airplane, among other things.
- Driver's licenses in the hands of illegal aliens and potential terrorists render them nearly invisible from federal immigration enforcement authorities.
- States that endanger homeland security by ignoring the obvious potential consequences of granting driver's licenses and identification documents to illegal aliens, including potential terrorists, must be encouraged to change their laws or face loss of federal transportation funding.

It looks like Tom McClintock will be taking the lead on this. I would contact Tom's office on Monday to confirm that they are indeed persuing this, and probably contact the Attorney General by Tuesday or Wednesday to make sure that someone has submitted the referendum petition. (
http://www.caag.state.ca.us/initiatives/faq.htm) Once that happens, the Attorney General will hold the measure for 15 days to prepare a title and summary. Since the AG is a Democrat, I would not expect it to be done any sooner. Once that happens, then petitions should be printed out and signatures gathered as quickly as possible.
I know that everybody is angry and wants to do something NOW, but we need to hold our fire for about two weeks while the Democrats try to stall the referndum. In the meantime, McClintock will probably file a lawsuit to hold it as a backup for the referendum. One advantage of the lawsuit is that the law can be thrown out completely. But Tom is right to go on both fronts here.

I wonder if the Colorado statute would withstand a court challenge? It would seem to violate the full faith and credit clause of the Constitution. The purpose of a driver's license is to establish that the individual has the basic skills and knowledge to operate a car. As long as Cali's licensing system meets an acceptable level in that area, I don't see how other states can refuse to honor it, just because some of the people holding Cali licenses are in the country illegally.

Count me in. Allowing non-citizens to stroll up to the voting booths and claim they are citizens eligible to vote is an outrage. It undercuts the very lawful foundation which politicians themselves stand upon: the consent of the governed.

1/4 or 1/5 the amount required for the recall. More like 1/5 of the amount collected for the recall. Maybe someone already mentioned this.
For a referendum, we need 5% of the last vote for governor in 90 days.
For an initiative, we need 5% or 8%, depending on whether it's a statutory or constitutional amendment, in 150 days.
To recall the governor, we need 12% in 160 days. We actually collected around 25%.
Given the 2002 turnout, we would need around than 374K signatures for 5%. Add a margin of 20% to be sure, and we're looking at needing around 450K signatures in 90 days.
McClintock's car tax repeal constitutional initiative and car tax reduction statutory initiative are ready for circulation. Initiative petitions have 150 days. Since the clock started just a few weeks ago, the referendum petition could be circulated with the initiative petition. That might save some money or be more convenient for some people.
