"for at least $25,000 plus punitive damages"Wanna bet the punitive is seven figures?
I don't get it. How would it have changed things if the park HAD given a warning of an electrical storm? Given a warning, the family would have left the amusement park and .... boom!
Now, if he would have been struck IN the amusement park without any park warning of a storm, he could claim that, if warned, he wouldn't have hung around and it wouldn't have happened.
Even in that case, I don't see how weather forecasting is an action that can be sued. Wish it was so I could stick it to the local forecaster.

This is one of those cases where the judges will not just dismiss the case, they will compose a poem for the occasion.

"Ok here in NC when we get a storm there is usually a darkening of the sky, thats our first clue.....then we pretty much hear the thunder coming our way and the lightening flashes."
I seen what you are talking about, what a coinsidence. I've also noticed that sometimes the wind will pick up too.
I think we should tell someone about this.

This attorney should be fined for legal costs and punitive damages for filing this.

Given his fear of the outdoors, they should not have had difficulty finding him. Bext time he goes awol, they should check under the bed or the closet.

Family sues Amusement Park for 'Act of God', because God is not sueable...There was a "Sam Gunn" sci-fi story many years ago where the government of Ecuador sues the Pope. The government had lost multiple millions when some insurance claims were denied due to the "Act of God" clause. Since the Pope claims to be God's representative on earth, and while individuals (and corporations) cannot sue nation states (which the Vatican is considered), governments can. I have wondered what would happen if such a thing were to really happen. And what court would have jurisdiction? And how would it be enforced? It might be interesting to see the military of some 2nd or 3rd world country shoot their way through the Swiss guards at the Vatican and confiscate the art collection. The Swiss guards there are good but there are not that many of them. The international repercussions would be interesting, to say the least.

OK, so if they HAD warned him what would he be doing?
Going to his car to get out of there.
Just like he did.

I wonder if they are naming God as an unindicted co conspirator. What did God know, and when did he know it?

"Loser pays" and this frivolous lawsuit would never had seen the light of day.

Well, this sort of thing can't happen at Disney, because God's not allowed there.A hearty 'Amen' to that! (too funny)

Of course, there's hell to pay if you lose.

What did God know, and when did he know it?Could be trouble. Apparently God knew it all, and from the very beginning.

If the park was closing due to the weather and forced the visitors to the parking lot rather than letting them stay under cover in the park until the storm passes, then the park should be liable.
I know places that due just this. Get everybody out RIGHT AS THE STORM GETS STARTED. That way they can send employees home early and cut the payday short, saving money.
I don't know if this was the case, might be though.
