Assault Weapons Ban : not any more - its way worse.

All you anti-AWB people : listen closely. The "extended" assault weapons ban would ban TONS of guns, including ALL semi-automatic shotguns, ALL shotguns that hold < 5 rounds, M1 Garand, Mini-14, ALL semi-autos that can have > 10 rounds with or without fixed magazine.

Gives the attorney general the ability to declare a gun "not sporting" and subsequently ban it.

That's right folks, its the big one. They want 'em all. -Still- feel playing complacent about them not taking away your guns? If this goes through, handguns are toast in <= 5 years. 30 caliber rifles next. Then, there's not much left.

Its bad.

It's bait and switch time once again. The Dems offer up this crap, and suddenly the current ban doesn't look so bad. When the Republicans go for the compromise--the renewal of the current ban--everyone will sigh with relief. SOP.

Ding! This is a GOOD thing. Have the most extremist no-compromise catch all bill possible. Don't try to strike a deal with them, just let it hang out there. Then send out a Red Alert to every related interest group there is. It will die a quick death.

I do worry that some outrage done with an "assault rifle" could turn Republican spines to jelly at the critical moment, in timr for them to go with the flow and vote for the new even worse AWB.

This could be a bargaining chip for another issue. Dems end the judges fillibust if this passes? Tax cuts? Other stumbling block?

Or as a Lautenberg type Midnight Special? An attachment to another bill? The reps didn't even read the patriot act.

Out in Minnesota, CCW was attached as a rider to steamroll the dems that used a procedural method to kill it last time. Nothing is to say that it can't be done the other way.

Columbine II.....with an Arab shooter(I think that could be Port Arthur there.)

Or A "Compromise bill" passes that takes out some of the other models....and leaves the Attorney General portion in, which is the worst part. Or takes out the AG part, and leaves the rest in. Or leaves the M1 Garand and bans the others.

There are too many variables that factor in here.

Not a problem. I agree with Ron Paul on this; the individual States enjoy the (unfortunate) Power to give Rapists and Murderers a free hand in their Territory, if they really want to outlaw Guns in their own jurisdiction. The important thing is that the Federal Congress has no Constitutional Right to even address the matter of Gun Ownership... at all.

Congress has exclusive authority over interstate commerce; it was given such authority in part to prevent states from restricting it. Since these lawsuits are being filed precisely for the purpose of interfering with interstate commerce, I would think Congress should have the authority to ban them. Also, per IV.1: "Full Faith and Credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. And the Congress may by general Laws prescribe the Manner in which such Acts, Records and Proceedings shall be proved, and the Effect thereof." What if Congress declares that judicial actions against gun manufacturers in other states shall be nullified?

I disagree. In my opinion, the States enjoy the Right to permit Gun Lawsuits within their own jurisdiction.

In my opinion, a proper reading of the Interstate Commerce clause would permit the States to declare all Profits accrued by Gun Manufacturers within their jurisdictions to be Forfeit By Law.

In other words, New York should have the Right to declare Profits accrued within the jurisdiction of New York to be Forfeit By Law, but not Profits accrued outside of New York. (If this interpretation were applied, the Gun Manufacturers would very soon refuse to sell Guns inside of New York... and New York would die on the vine. But the "States' Rights" of New York would remain intact).

That's just a "working opinion" on my part, I'm still chewing on it... but it makes sense to me.

Thoughts?

I'll stand by my belief that the original AW Bill will die per a back door agreement and a new and unconstitutional Socialist BS ban will be "attempted" just in time for 04 campaign ............
