David Koresh did the same thing with his girls -he married them first, and then raped them.

"On the night of the kidnapping, Dinse said Mitchell had cut through a screen window, threatened Elizabeth with the knife -- not a gun as the police had previously reported -- and took her outside through a screen door."

I got whacked in the temple once by a steel bar at work. I went out cold. And I had the worst grinding, burning headache for a week afterward.

Good post explaining brainwashing. Who knows, the psycho could have been telling that little girl from Day 1 that her parents didn't care where she was. After a few months of no one finding her, she could have believed it, and psycho creep could easily twist her mind around anything else.

Regarding sensory depravation, that seems like it would be the easiest for the kidnappers (in Patty Hearst's case) By the time they did talk to her, she was probably thankful to hear anything.

His advocation of the Amber Alert is perhaps well-intentioned, but the way he approached it and the timing of his comments, seem to be as hollow as his (and Mrs. Smart's) lack of common sense of hiring people from the streets to come to their home. They have to accept they made their own mistakes in this, not just the investigators.

He is a leftie trying to score political points against conservatives and Republicans on the back of his kidnapped daughter. He may also think he can make a future "John Walsh" tv deal out of this thing. I wouldn't urinate on him if he were on fire. He thinks his "If any more children are kidnapped it will be the fault of the Republicans" will get him some personal traction.

Your point that he and his wife hire people off the books to avoid having to pay them minimum wage or SS benefits is just further proof of how shallow he is. The only one at fault for his daughter's kidnapping is the kidnapper. Providing she didn't run away from home to get away from that creep, that is.

Would there be charges for kidnapping and charges for kidnapping with return?

Sure, why not? You could have kidnapping with "special circumstances" (like the death of the child) as a automatic death penalty, and kidnapping where the child is released unharmed as a basic felony with maybe a 5 year sentence, adjusted upward SHARPLY if the child is harmed in any way.

Unfortunately the Supreme Court held in Coker v. Georgia (1977) that the death penalty for rape violated the Eighth Amendment (cruel and punishment). I think that kidnapping is covered under the ruling.

You are probably right, but the SC were wrong to do this, and it needs to be changed. Physical rape is nothing compared to the mental rape kidnap victims go through, especially children kidnap victims. What can be crueler than keeping a child in a state of perpetual terror, and making them think they will never again be safe? Most adults can't even handle this. Why else do you think so many people are willing statists who see the government as the "ultimate daddy" who is going to protect them against all harm or risk? It's because the thought of being on their own terrifies them, and these people are adults who can reaonably be expected to cope with just being on their own. It can't begin to compare with the terror a child feels at not only being abandoned (and you KNOW they think this deep down),but being a slave who must do whatever their captive wants in order to just continue to live.

According to the NOW Nags it's the same thing....

They would be surprised at how little I care about what they think.

Good information in that post.

Now go back and look carefully at what you've written, think about all the things you've said there, and think about them in the context of this case (the younger sister's recollection of the guy's description months later, the confusion about whether Elizabeth was abducted with a knife or a gun, the fact that Elizabeth was out in public on numerous occasions and never sought help, her repeated denials to the police that she was Elizabeth Smart, etc.).

I don't know about anyone else here, but I'm thinking there's no way in hell anyone could ever be convicted of "abducting" her.

The message then becomes, lay off enforcing plural marriage crimes.

Hey, if homos can "marry," why not? I expect polygamy laws to fall shortly after homosexual marriage laws are passed. And from there, who knows?

I've never understood why the date someone comes on makes any difference whatsoever as to the validity of their personal opinions.

Well for one reason, it shows that you're a more hmm...moderate ... poster in all likelihood.

And is also a flag for you being one of the Oprah contingent. (I like the phrase...and am gonna run with it)

If you help a minor to "run away" and keep possession of them, that's kidnapping. 14 year-olds cannot consent to that behavior.

The old "the slut was asking for it" doesn't apply to 14 year-olds.

UT did put a guy away recently that was married to several willing women. He got 5 years I think.

Lucky bastard. 5 years is much better than the life sentence he was already in :)

The point with Patricia Hearst, and probably Ms. Smart, is that they had never been put through fire. While they were restricted, they were also protected. They'd never been hungry, never felt real pain, never been exposed and humiliated.

If you take a young individual who has a basic respect for authority, put them through sensory deprivation, humiliation, and then careful positive reinforcement of the paradigm you want them to adopt, you can completely control their thought process.

Well said. And most times far less effort is required to "break" a person. I knew someone from a good family who was "brainwashed." Knowing a victim well gives you a different perspective on it.

Notice how often sexual deviants use religion to justify their lusts?

True. Although usually these are small cults with a leader who believes himself to be a prophet of God, if not a god himself. OTOH, the dirty little secret of atheism is that the atheist makes himself God by creating his own moral code in order to justify some sinful practice, usually a sexual sin.
