Senate Bill S.22

Justice Enhancement and Domestic Security Act of 2003 (Introduced in Senate)

BALLISTICS, LAW ASSISTANCE, AND SAFETY TECHNOLOGY

SEC. 5214. TEST FIRING AND AUTOMATED STORAGE OF BALLISTICS RECORDS.

(a) AMENDMENT- Section 923 of title 18, United States Code, is amended by adding at the end the following:

`(m)(1) In addition to the other licensing requirements under this section, a licensed manufacturer or licensed importer shall--

`(A) test fire firearms manufactured or imported by such licensees as specified by the Secretary by regulation;

`(B) prepare ballistics images of the fired bullet and cartridge casings from the test fire;

`(C) make the records available to the Secretary for entry in a computerized database; and

`(D) store the fired bullet and cartridge casings in such a manner and for such a period as specified by the Secretary by regulation.

PART 6--CLOSING THE GUN SHOW LOOPHOLE

[The findings read like a laundry list of anti-gun lies.]

SEC. 5252. EXTENSION OF BRADY BACKGROUND CHECKS TO GUN SHOWS.

`Sec. 931. Regulation of firearms transfers at gun shows

[establishes gun show promoter registration and vendor registration, among other things, and]

`(c) RESPONSIBILITIES OF TRANSFERORS OTHER THAN LICENSEES-

`(1) IN GENERAL- If any part of a firearm transaction takes place at a gun show, it shall be unlawful for any person who is not licensed under this chapter to transfer a firearm to another person who is not licensed under this chapter, unless the firearm is transferred through a licensed importer, licensed manufacturer, or licensed dealer in accordance with subsection (e).

`(2) CRIMINAL BACKGROUND CHECKS- A person who is subject to the requirement of paragraph (1)--

`(A) shall not transfer the firearm to the transferee until the licensed importer, licensed manufacturer, or licensed dealer through which the transfer is made under subsection (e) makes the notification described in subsection (e)(3)(A); and

`(B) notwithstanding subparagraph (A), shall not transfer the firearm to the transferee if the licensed importer, licensed manufacturer, or licensed dealer through which the transfer is made under subsection (e) makes the notification described in subsection (e)(3)(B).

`(3) ABSENCE OF RECORDKEEPING REQUIREMENTS- Nothing in this section shall permit or authorize the Secretary to impose recordkeeping requirements on any nonlicensed vendor.

`(d) RESPONSIBILITIES OF TRANSFEREES OTHER THAN LICENSEES-

`(1) IN GENERAL- If any part of a firearm transaction takes place at a gun show, it shall be unlawful for any person who is not licensed under this chapter to receive a firearm from another person who is not licensed under this chapter, unless the firearm is transferred through a licensed importer, licensed manufacturer, or licensed dealer in accordance with subsection (e).

Regarding Gunshow "Loop-Hole" Nonsense -
Dept. of Justice: Firearm Use by Offender - Table 8:

1991: Source of guns used in crimes by state prison inmates -
* 40.8% from street source (drug dealer, theft, blackmarket).
* 33.8% from family or friend.
* 18.9% from retail store or pawnshop.
* 0.6% from gunshows.

1997: Source of guns used in crimes by state prison inmates -
* 39.2% from street source (drug dealer, theft, blackmarket).
* 39.6% from family or friend.
* 12.1% from retail store or pawnshop.
* 0.7% from gunshows.

Guns used in crimes are very RARELY ever obtained by the criminal through gunshows.

Regarding "Ballistic Fingerprinting" Nonsense -
Feasibility Of A Ballistics Imaging Database For All New Handgun Sales

"Firearms that generate markings on cartridge casings can change with use and can also be readily altered by the user."

"They are not permanently defined identifiers like fingerprints or DNA. Hence, images captured when the firearm is produced may not have a fixed relationship to fired cartridge casings subsequently recovered."

"Cartridge casings from different manufacturers of ammunition may be marked differently by a single firearm such that they may not correlate favorably."

"Changing the signature of a breech face or a firing pin impression... was a relatively easy affair. The minor alteration required less than 5 minutes of labor... This change is sufficient to make the cartridge case breech face unrecognizable..."

"Proposed systems will not practically accomodate revolvers, rim fires, certain shotguns and rifles."

"This study indicates that this number of candidate cases will be so large as to be impractical and will create logistical complications so great that they cannot be effectively addressed."

A ballistic fingerprint database of all guns is unreliable, impractical and ineffective.

This provision is ALREADY in violation of existing Federal law. This thing is dead on arrival.

Problem....

I just searched Thomas and found that the only Senate Bill "S.22" was not directly gun-related.

"S.22

The specific articles listed in the original post don't appear in the version on the bill listing.

I don't know if the specific sections quoted have been dropped or what....very strange.

You may have looked at the summary. Here it is:

TITLE I--COMBATING TERRORISM AND ENHANCING DOMESTIC SECURITY

Sec. 2144. Forensic and investigative support of missing and exploited children. Sec. 5214. Test firing and automated storage of ballistics records.

If you really want to get sick look at the whole bill. It covers everything under the sun in it from crackhouses to student loan waivers for public attorneys to telemarketing. This should be defeated on that basis alone.

Every time I try one of your links for info on the bill, I get a page that says Please resubmit your search Search results are only retained for a limited amount of time.Your search results have either been deleted, or the file has been updated with new information.

I have searched and still cannot find the references - I do believe you, but they sure don't make it easy for us "normal citizens" to find the full contents...

It must use cookies (One part of the URL i gave was a temp folder - my bad)

Go to Thomas and do a search for S.22 in the box for bill number. Once there scroll down about 4/5 to the bottom (they are generally in numeric order) and you will see:

I am writing to you about my Second Amendment freedoms. I am aware that Senate Bill S.22 has been introduced. This bill contains provisions that will put more restrictions on firearms by attempting to make private party firearm sales illegal. The bill also attempts to get ballistic images of fired bullets and cartridge casings from different firearms that will be very costly and ineffective.

If this bill is passed it will infringe on my family's privacy and right to keep and bear arms. I am calling on you to protect and defend the Constitution by voting against this bill.

This law only puts more needless restrictions on firearms. Americans are peaceful citizens that do not need more regulations piled upon them that will erode the Bill of Rights. The Second Amendment is a vital part of American freedoms. Support the freedoms of American citizens and vote against this bill.

Unfortunately, Michigan doesn't have senators that would be responsive to any concerns I would convey to them. senator lenin and senator stabemall have convinced the limp wrists in Michigan that they will receive appropriate and timely protection from the government. Can I write to your senators?
