in other words, even if Kerry is in the hospital, Daschle and Reid only need 40 on their side, not 41. (Kerry's absence does not hurt them).

I still say, since no just cause to has been given to delay a simple up or down vote...these dem dirtbags need to asked why they are acting like such racists?

but his term is up DEC.31 2004!!

yes, just 40 I guess; but as Rush said today, it has gotten to the point, in recent days, where they only have to threaten a filibuster.....then the other side scrambles immediately to get the 60 they need. A filibuster doesn't even have to happen to usually get the other side to back down, just the threat.

I believe he was working for Ted Olson at the time he argued before the supremes. Hitlery was the only senator to vote against confirming Olson.
