A vacancy could open up in the U.S. Supreme Court soon

Feb. 17 issue: It's been nine years since the last vacancy opened up on the U.S. Supreme Court. That historically long drought could end this year with at least one resignation. Eager White House aides are stepping up preparation efforts, vetting candidates and contemplating a special media operation to deal with a potential confirmation battle.

Other observers think Bush could take another approach, appointing California Supreme Court Justice Janice Rogers Brown instead. Brown is a conservative African-American who's ruled against affirmative action and abortion rights. Her nomination would let Bush add the court's third woman and second African-American in one swoop. And White House lawyers have already interviewed her. Tom Goldstein, a Washington lawyer who argues cases before the court, believes Brown could even get the nod for chief justice. "An African-American female nominee is not going to be filibustered," he says. She doesn't have a record that will stop Democrats in their tracks. And after months of bitter Senate fights over nominations to lower courts, that could have an appeal all its own.

How do you bork a qualified African-American without alienating a part of your base? People forget Clarence Thomas got through because demz couldn't take the heat after they tried to bork him. It'll be ten times harder with a black woman candidate.

I don't know anything about Brown. I do know that if MSNBC calls her a "conservative" that means she is a moderate liberal. If she were a genuine conservative than MSNBC would call her a "right wing fanatic."

There once was a saying that "Only two groups of people are really free in this country - black women and white men" (meaning they can say whatever they want). A good test of that could be forthcoming!

I just scanned the first few posts, so if this has been answered, please point me to the relevent post:

I'm a bit different from most here regarding potential judges; their opinions regarding abortion, for instance, mean as less than nothing to me.

What I would REALLY like to know about Judge Brown is, how does she feel about such REAL issues as the Second Ammendment, the War On Drugs, private property, free speech, and OTHER direct Constitutional issues.

Would she vote to overturn restrictive gun laws? How about seizures of property by environmental agencies? does she support the Freedom of Speech, Press, Religion, and the Rights of Assembly and Grievance? What about Privacy?

Sorry to be blunt, but by zeroing on peripheral issues such as abortion to the exclusion of all others can be to risk a dangerous appointee. I WILL NOT trade all my OTHER rights so half the population should LOSE one of theirs.

The U.S. Supreme Court already ruled on the Right of Free Speach. They haven't yet ruled on the Second Amendment. Why do you think we have gun control in states like California that have no Right to Keep and Bear Arms in their state Constitution?

Based on what you posted she seems like she is subordinate to the legislature unless the constitution contradicts them. You cannot ask for more than that. Any more and she would be an activist.

Okay, so AT BEST, we have no idea HOW Judge Brown would vote regarding the Second Ammendment. On other matters, she does seem mildly right-wing. Hmmm.

I'm back to wondering just how long the Republicans are going to let the Dims force them to scour the nation for the two or three conservative, minority, and qualified justices out there. Couldn't we just, for the love of God, find someone who REGARDLESS of Race, Color, Creed, or Planet-Of-Origin can just read the Constitution and apply it consistently to disputes regarding it? When will we stop placing that document, ALL of it, at risk just so the Dims won't squeal like pigs (which they'll do anyway)? There must be THOUSANDS of qualified jurists and other citizens who could do the job and about whom we'd NEVER need to worry.

That's what it looks to me from the information I had. California has no RKBA, so that answers that question, but I need to know how they argued against the AW ban there. If the challengers mentioned the 2nd amendment IN THEIR briefs, it can sway me against.

I need to look that up. I'll admit that I have a prejudice against Californias to start with on gun issues, so I need to be certain before I saw "This person deserves me support".

My first choice is either Robert Young, Stephen Markman, Cliff Taylor, or Maura Corrigan. Those four run Michigan's Supreme Court and are strict constitutionalists.
