ACU Members, Supporters, Friends, and Activists:
The time has come once again to make your voice heard on Capitol Hill. Today, Wednesday, February 5, at 2:15 pm EST, the entire Senate will vote on the nomination of Miguel Estrada, President Bush's nominee to the Court of Appeals for the District of Columbia, and we need to let the Senate know how important it is to confirm this fair, and conservative nominee.
The Ultra Liberal Democrat machine is geared-up for this fight. Remember those liberal Democrat Senators on the Senate Judiciary Committee who worked to make sure that the full Senate would not vote on this conservative lawyer and other well-qualified nominees? Their quest to thwart the President's nominees to the federal bench continues?
Because the Republicans regained control of the Senate by the smallest of margins (51 votes), the Democrats have threatened to prevent a floor vote by engaging in a filibuster-which requires 60 votes to defeat-and that's why we need your help! We can make sure that they lose this important vote on the floor of the Senate, too!
Call your two Senators and urge them to "Vote against the filibuster, and vote in favor of Miguel Estrada."
The embodiment of the American Dream, Estrada emigrated from Honduras at the age of 15; two years later he was accepted to Columbia College, from which he graduated Magna cum Laude. He received his law degree from Harvard Law School, in 1986, once again graduating Magna cum Laude. He also served as a law clerk to Supreme Court Justice Anthony M. Kennedy, as an Assistant U.S. Attorney, and as the Assistant to the Solicitor General to the United States. The fact of the matter is that he is more than qualified to sit on the Court of Appeals for the District of Columbia.
In an effort to rally their own members, some ultraliberal fringe interest groups have even called the fight judicial "Armageddon".

Urge your two Senators to "Vote against the filibuster, and vote in favor of Miguel Estrada!"
If we all do our part, calling the Senate before 2:15 pm EST on Wednesday, February 5th, we can get the job done and hand the left another loss on this important issue.
Hit those phones folks, and let's get the job done for President George W. Bush and his nominee to the Court of Appeals for the District of Colombia, Miguel Estrada.

I just called Kennedy and Kerry of Mass
I am not sure about Kennedy, but Kerry is for the fillibuster and against the nomination they told me if I heard correctly.

Thanks for the ping. Chuckie Schumer is giving the nation a history lesson on the Constitutional convention - how for a short time the power to appoint judges rested solely with the Senate.
"For those of us who revere the Constitution and believe in the rule of law...I believe that we are God's noble experiment. The Senate must hold up its end of the bargain. We have a duty to the judiciary, to the Constitution and yes, the American people."
"We have an obligation to be vigilant defenders of Constitutional obligation. We must live up to the standards of those who came before us."
God is saving the lightning for later, I guess. Chuckie's accusing us of making personal attacks.
"It's deeply and solemnly necessary to uphold the will of the Founding fathers." Oh, please! Chuckie should read the Constitution again. It would tell him that he is no longer a member of the majority. "Will of the people" and according to the Constitution.
"This goes to the very sacred obligation each of us has when we take that oath of office."

When you contact your Senators, be sure you tell them that we know why the dems want to get rid of Estrada.
Because ... during the 2000 election aftermath, Estrada presented a legal document to the USSC in Bush v. Gore.
You got it! ... This little stunt is RETRIBUTION for his actions. How small, petty and childish is this ...??

Dear President Bush,
With the Surpeme Court session getting ready to close, it may well be time for perhaps the most important domestic decision of your presidency: the appointment of a Supreme Court Justice(s). The main reason why I supported you in 2000 and why I wanted Daschle out of power in 02 (and 04) has to do with the courts. I want America courts to interpret law, not write law. During your presidential campaign you said Thomas and Scalia were your two model justices. Those are excellent models. The High Court needs more like them. Clarence Thomas recently said to students that the tough cases were when what he wanted to do was different from what the law said. And he goes by the law. This should be a model philosophy for our justices. Your father, President Bush lost his reelection campaign for 3 main reasosn, as far as I can see. 1. he broke the no new taxes pledge 2. David Souter 3. Clinton convinced people we were in a Bush recession (which we had already come out of by the time Clinton was getting sworn in)
I urge you to learn from all three of these: 1. on taxes, you're doing great. Awesome job on the tax cut. 2. good job so far on judicial appointments. I want to see more of a fight for Estrada, Owen, and Pickering, but I commend you on your nominations. 3. by staying engaged in the economic debate you'll serve yourself well
I have been thoroughly impressed with your handling of al Queida, Iraq, and terrorism. You have inspired confidence and have shown great leadership.
But I want to remind you that your Supreme Court pick(s) will be with us LONG after you have departed office. I urge you to avoid the tempation to find a "compromise" pick. Go for a Scalia or Thomas. Don't go for an O'Connor or Kennedy. To be specific, get someone who is pro-life. Roe v Wade is one of the worst court decisions I know of, and it's the perfect example of unrestrained judicial power.
I know the temptation will be tremendous on you to nominate a moderate. But remember who your true supporters are. I am not a important leader or politician. I am "simply" a citizen who has been an enthusiatic supporter of you. I am willing to accept compromise in many areas of government but I will watch your Court nomiantions extremely closely. What the Senate Dems are doing right now is disgusting, but as the President you have the bully pulpit to stop it. Democrats will back down if you turn up serious heat on them.
Moreover, I think public opinion is shifting towards the pro-life position. Dems will want you to nominate a moderate, but almost all will vote against you anyways. Pro-choice Repubs will likely still vote for you if you nominate a Scalia, after all, you campaigned on it. So Mr. President, I urge you to stick with your campaign statements and nominate justices who believe in judicial restraint, like Scalia and Thomas.
