Albany NY attorney fired for supressing 2001 arrest of William Scott Ritter

-------------------------------------------------------------------------------- COLONIE - The assistant district attorney who handled a 2001 misdemeanor charge against former U.N. weapons inspector Scott Ritter has been fired for failing to tell her boss the case ever even existed. "I was shocked and angered to learn that the case had been disposed of by one of my assistant district attorneys without consulting me," said Albany County District Attorney Paul Clyne. "Any arguably sensitive case should be brought to my attention."

Details of the specific charge against Ritter, who sources said was arrested by Colonie police and charged with a class B misdemeanor on June 15, 2001, were sealed.

On Friday, Clyne fired Assistant District Attorney Cynthia Preiser, who had worked in the DA's office for 15 years. She did not return calls for comment.

re Clyne. From my knowledge, he's a pretty straight shooter. Even had Repub. support for his candidacy.

From the statement in the article, it appears that he was upset by not having had a heads-up from his assistant re this Scott Ritter character who was emerging as a very public figure.

I don't think any boss would appreciate being blindsided by a reporter's inquiry, especially if that boss is a publically elected official.

ALBANY - Former UN weapons inspector Scott Ritter was secretly prosecuted in Albany County in 2001 after he was snared in an Internet sex sting operation, law enforcement sources told the Daily News .

He was arrested by Colonie Police in June 2001 on a misdemeanor charge after he allegedly had a sexual discussion on the Internet with an undercover investigator he thought was an underage girl, law enforcement sources disclosed on condition of anonymity.

In all fairness, however, the article indicates that he was charged, not convicted. SOP for defense lawyers is to ask the court to seal the record if the charges are dismissed or dropped, particularly if prosecutorial error is an issue.

But not a case of mistaken identity, as Ritter claimed. The charge would've been dismissed outright and the record sealed. This wasn't. The case was left open in what we call in Wisconsin a deferred prosecution agreement (meaning that if Scottie was a good boy for the duration of the agreement, the charges are dismissed and the record sealed). And surely the ADA would've and should've told her boss about who had been arrested and charged. It sounds like a sweetheart deal between the prosecutor and Ritter's attorney, and for some reason, neither thought that the feces would hit the rotating impeller at anytime in the future.

How often do you hear of a DA firing an ADA with 15 years experience? Discipline, a short suspension, sure. But outright "we've cleaned out your desk and get the hell out of here" canning?

I think this isn't the full story. I also have this feeling that when the national press gets ahold of this--and they will--it isn't going to be pretty for Mr. Ritter. And that's a good thing.

This story gives a precise date of the arrest, June 15, 2001. I wonder what Ritter was doing, vis-a-vis Iraq, around that time.
