Illegal Immigration: A novel approach to the greatest security threat we have

A while back, I posted a thread on State Defense Forces and their role in Homeland Security. This is part two of the series.

A lot of media attention has been devoted to the problem of Illegal immigration along our Northern and Southern Borders. Calls for Federal Troops to be stationed there, the National Guard, and even hiring more Border Patrol Agents.

The Congress and the President seem to ignore the problem while crime escalates in the border regions and our citizens are threatened with serious crimes, as well as the obvious national security concerns.

Private militias have formed to protect citizens, and the problem is still ignored.

My question is: Why is this just a federal only problem? The states have the same authority as the Federal Government to station troops on the borders to stem the flow of illegal aliens, and are neglecting this role just as badly as the Feds are. The only problem is the State Governors arent facing the same heat because people dont know the military laws of their state. ( who could blame them)

Every state has the ability to use its State Militia to patrol the border and interdict illegal aliens. In some cases, they have even more authority.

State Militias are authorized under 32USC 109 of the United States Code.They are usually called "State Defense Forces" because federal statutes refer to them as such. Every state has statutes (under the shared responsibility clause of the Constitution governing military defense) to allow it to use the state militia at the discretion of the governor to do the following:

1) Invasion, insurrection, or threats of either 2) when any combination of person(s) become so powerful as to obstruct the execution of laws 3) WHEN THE GOVERNOR DETERMINES A STATE AGENCY OR AGENCIES HAVING LAW ENFORCEMENT FUNCTIONS ARE IN NEED OF HELP IN PERFORMING THESE FUNCTIONS 4) Disasters 5) Emergencies of lesser magnitude ( as determined by the Governor-this is a catch all) 6) counter-drug duties

As anyone can see, a State Governor would have every justification in the world to call out the State Militia ( State Defense Forces) to secure our borders.

About 26 states have State Defense Forces. SO far, none have state troops detailed to curb illegal immigration or secure our borders from outside threats. They could keep Federal troops free from this duty so they could be used overseas in the impending war.

Why are we letting the states off the hook here? Because no one knows about these laws, or no one cares to know about them.

I suggest we start hounding our state governors and representatives to get on the ball as well as the Feds on this issue.

Excellent ideas and would probably be a lot more effective in the long-run. A web site could even be set up, if there isn't one already that specifically targets known employers hiring illegals. Hit them where it hurts, economically.

State Defense Forces are also exempt from Posse Comitatus. They could do full law enforcement duties. Thats good to know.

Jeez, don't give the liberal Janet Reno's out there more ideas! ;^)

Not to mention those that are felons. DOJ estimates average loss due to felony crimes is $430,000.00 per miscreant, per year.

The cops would love to get rid of illegals but the INS has thrown up serious redtape to make sure this doesn't happen.

I read of an illegal (N. Africa) that had been arrested several times. Cops couldn't do anything cause the INS didn't want to do anything (cause he hadn't been convicted yet). Finally the guy applied for asylum so he could stay here "legally" till his case was decided.

He was arrested once more on more serious charges. Released (once again) on bail he fled to Canada. As far as I know the Canadians are still holding him for extradition back to the U.S.

What we have going on with Mexico is not immigration, it is an invasion. The govt. of Mexico published a report stating that over 35 million Mexicans have entered the USA, some reports I have read say that as many as 13 million or in Southern Calif. alone

Our Government can not own up to these numbers. Elected Republicans cannot admit the magnitude for fear of absolutely enraging the lower end of their base. Elected Democrats cannot, for fear of forever alienating the African-Americans, who IMHO, are paying the biggest price for the invasion, along with hourly employed white men.

I do not have a clue as to when and even if the boiling point on this situation will be reached. I do know there is occasional open warfare between Blacks and Mexicans on the streets of LA. And I also know that even here in Maine, illegal Mexicans are filling in jobs in the tourist industry in large numbers, while legally present Somali "refugees" who are also here in large numbers do no work at all, while collecting rather substantial benefits in cash and kind..

All the while, the illiterates who leave our once-excellent high schools every year are fit for nothing ... except to hang out and try their best to act as if they were in an MTV video.

Border protection and adherence to existing immigration law is crucial. Low-end jobs should go to low-end Americans. They need the money, the training, and the chance to improve themselves before the country is given away.

I haven't seen that number before. If you find a link to it, I'd appreciate it.

There was a recent thread here, I should have kept a link to, that speculated that as much as 50% of our nation's prison populations could be Latino. When Latinos enter the prison populations in many states, Arizona for instance, they're classified as 'whites'. How many of them are illegals could be under-reported, as well.

Funny how when they're out to qualify for special government hand-outs, school placement, government jobs or to beat you out of a government contract, they're Hispanic/Latinos. But, when they're thrown into prison, in some states they're no longer Hispanic/Latinos, they're 'white'.

The latest I've heard (from another FR thread) is that Fox has given up on getting Bush to pass an amnesty, and is now working on a "worker ID" so that Mexicans can cross the border to work. This has the implication that they will come across in the AM to work, returning in the PM. What part of this sounds ridiculous? Yeah, right. The part where they go BACK to Mexico.

The best way to stop illegal immigration is to "fine" the illegal immigrant's country of origin. The first time an illegal is caught, deport them and take away $10,000.00 in aid given to that country. For every successive catch of this illegal the tab doubles, $20,000 for second offense etc... The loss in revenue for Mexico would be in the hundreds of millions if not billions of dollars. Trust me at this given point these countries would lean heavily on these felons and probably patrol their own borders.

I cut that $430,000.00 figure out of an article I read years ago. I no longer know where it is. The same article said the average felon commits an average of 180 crimes a year. A lot of softheaded people don't understand that criminals don't have any interest in being straight - they have no interest in being rehabilitated - they were never "habilitated" in the first place. They just chose to be, and want to be, criminals. Kinda like sodomites.

If someone would fund it, I would establish such a site, and open it up to a group who want's to maintain its content. To do it right would not be cheap, but not that expensive. The key thing is to do our own hosting, so anyone who complains (and once it became successful there would be people who would use the federal bureacracy to lean on any hosting ISP) would have limited leverage.

Probably use something like a modified "Twiki" type site so that a large number of authorized people could post.

That sounds like a good idea, expose businesses hiring illegal aliens and have a message board people could post to. There may be some web sites already up doing this sort of thing, I'm going check around to see first.
