Waitress hit by car dies

01/03/2003

By KIMBERLY DURNAN / Dallas Web Staff

A 22-year-old waitress died from severe head injuries after she was struck early Friday by a car occupied with four people who had walked out on their restaurant bill at an Irving Bennigan's, police said.

Jennifer Sanchez, of Grand Prairie, was taken to Parkland Hospital where she underwent surgery for her injuries.

Ms. Sanchez had gone into the restaurant parking lot just after 1 a.m. to get the license plate number of four patrons who had just walked out on their $100 restaurant tab, Irving police spokesman David Tull said.

Witnesses told police that the brown, 1978 Chevy Nova backed up and struck Ms. Sanchez and then sped up dragging her several feet before throwing her from the car.

Three of the car's four occupants were later arrested for aggravated assault and police said they expect to make an arrest for the fourth occupant. Those arrested are an 18-year-old Irving woman, a 19-year-old Midlothian woman and a 19-year-old Duncanville man. The names have not been released pending arraignment.

Ms. Sanchez had worked at the restaurant as a hostess and server since May 2001, spokeswoman Tricia Coghlan said.

The servers are not required to cover checks of patrons who leave without paying, she said.

"If there is a theft, a manager needs to keep an eye on the suspect while someone calls police," she said. "If someone leaves before the police arrives we don't try to detain them. A manager will try to write down a description of the suspect or the vehicle and the direction in which they traveled."

Ms. Sanchez's father said his daughter was hard-working and had a promising future.

"She was a young lady, very full of life, working her way through school," Daniel Sanchez said. "She was very independent and a big-hearted person."

You know, I thought that headline was over the top until I read the story.

But on murder they'll walk. We'll get a teary "it was all a tragic misunderstanding and an accident and then we panicked" story. I'd be willing to wager they'll have trouble getting an aggravated assault conviction.

I would guess that they also pulled a "Clinton" and did not leave a tip.

I wonder if the arrests were based on the license number she had managed to finish writing down before she was run over.

I once read a story about a fellow who invented a pad of forms which read "in lieu of tip" for bad service.

He left one in a restaurant instead of a tip and the waitress became so enraged that she chased him into the parking lot with a heavy iron skillet and CLANG! concussion time.

=============================

The following happened to me:

A large group of people met at the Hollywood Hamburger Hamlet after seeing "ET" at the cinerama dome. I was at one end of the table and a highly obnoxious individual at the other end. Somehow he managed to pi$$ off the waiter, who went AWOL. I did not know why the waiter vanished but I became angry. We had to demand that the manager find the waiter and give us (at the other end) some service.

I was 'the banker' who was settling the tab. I was so angry at the waiter that I left a single nickel on the table as a tip. He walked over, saw the nickel, and asked, "Is that for me?"

"Yes..ss," I replied. He reached out and pushed it back at me. Already prepared, I picked up the nickel, replaced it with a penny, and pushed it back at him.

That's why I'd started with the nickel!

You might want to wait for their official response rather than for what a reporter chose to put in the story.

My guess is the restaurant is trying to cover themselves after it's become abundantly clear that they sold way too many drinks to a couple of underage punks.

Very sad story.

Last year, I was entering Shooter's in Ft Lauderdale when a skinny teenager came out running. I stopped and turned to see what the emergency was.

A car had pulled up and a lady was about to get into the passenger's side. The skinny teenager closed the door of the car and told the lady to go back into the restaurant. Then all hell broke loose.

The driver started screaming to the teenager, the rest of the waiters came out, the manager joined the spectacle and finally, everybody went inside.

Later, my waitress explained to me that the lady and her driver had walked out without paying their $150 bill. The skinny teenager was the busboy who had kept an eye on the couple, since they were acting suspicious when first the guy and then the girl left their table without paying.

I guess the skinny teenager could have had his face rearranged by the male driver, but thank Goodness, everybody came out right on cue to save him from the trauma.

It's hard to imagine a normal person carrying around a "bad service-no tip" pad. The mere fact that he designed and carried one undercuts his credibility as a person with no cheap chip on his cold shoulder.

The initial crime is a misdemeanor, "Defrauding an inkeeper." The three passengers will probably only be prosecuted for that. They will claim that they had no intention of hurting anyone and couldn't make the driver stop once he struck the waitress. Only a lawyer can assess the chances of convicting the driver of murder, but I think it is slim. Maybe some sort of felony hit and run, assault with a deadly weapon, or possibly a manslaughter.

Man...that poor young lady sounds like the kind of person anyone would want to hire for their business. Her dad is right, she definitely had a bright future.

I agree with the poster who says that they should angle for homicide in the act of a felony.

BINGO! Four people at $25 bucks each. Nothing at Bennigan's costs more than about 13-14 bucks. Burgers and appetizers will go for around 6 or 7. Unless these were the McD's Fat Kids, they didn't eat that much. But having been that age, I've had restaurant bills balloon when they include the bar tab. Leaving at 1 in the morning is the other clue.
