IT's such a laugh that Idaho and Montana fall under the Ninth Circus. Say, if there's no right to keep and bear arms, why don't they start with a confiscation in one of those two states?

Has to be a typo. The Second Circuit encompasses New York, Connecticut and Vermont. New York City alone alone has at least 7 million people, probably more, and the rest of the state probably equals (or exceeds) that.

BTW, the 1st circuit includes Puerto Rico whose number was not included in the list above. Nor was Samoa and the other islands' population which fall under the 9th included.

This is an excellent opportunity! The Ninth will be split and Bush can load BOTH courts with conservative judges! (Do we dare hope for several Clarence Thomases?)

Alaska might also be an interesting place to attempt confiscation. They never found Hale Boggs' airplane... ;-)

There is ample precedent for division of federal judicial districts; the 5th Circuit (which is directly at odds with the 9th Circuit over the RKBA issue) used to also include Alabama and Florida, IIRC.

You are correct. The old 5th Circuit included GA, FLA, and west to Texas. The circuit was split in the 70s with the 5th Circuit consisting of TX, MS, & LA, and the remainder making up the new 11th Circuit. It worked well then, with minimal disruptions, and can work again.

Whatever circuit California is in will be dominated by it and consequently ruined. Therefore, CA should be in a circuit by itself. Arizona and Nevada should be transferred to the 10th Circuit (see Ben's post #17), CA should be the new 9th Circuit, and the new 12th Circuit should be all of the other states from the old 9th Circuit.

That way, the 9th Circuit will still be awful, but only people in CA will be affected, and they are after all the ones most responsible for the situation.
