12-6-3. Filing for two offices at one election prohibited -- Party offices excepted. No person may be a candidate for nomination or election to more than one public office, no matter if such person appears on the ballot in name or is represented by electors pursuant to § 12-5-3.16 or 12-7-7. However, a candidate for any such office is not prohibited from being elected to any one or more party offices as may be provided in chapter 12-5.

Of course, it depends a great deal on a state's laws. But ... there is a new SD law which says Daschle cannot run for President and Senator at the same time.

To everyone talking about it -- 'filing for two offices at one election.' What does that code mean? Is it same ballot inside the local jurisdiction? Or does SD have some kind of funky thing about federal elections? (In which case, what's the jurisdiction for that)

I would guess it means if he runs for president he cannot run for his senate seat also. I don't think he has to resign his seat.

Seems to me the real significance of this (if true) is that it means that Daschle has concluded that there is no scenario under which he is going to become Majority Leader any time soon. There is no new "Jeffords" in the wings, no "palace coup" to be had. If he were going to be Majority Leader, he would not have time to run for President. |
