They can call themselves a "militia" all they want but they are not a Militia in the constitutional sense because they lack both the state and national sanction of being called up by either governmental body.

§ 311. Militia: composition and classes
(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.
(b) The classes of the militia are --
(1) the organized militia, which consists of the National Guard and the Naval Militia;
and
(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.
Clearly..NOT ALL Militia needs to be called up by the Government.

The organization "Civil Homeland Defense" has filed for 501 c 3 status, is NOT a militia and is NOT a group of vigilantes. In fact, the organization specifically disavows such terms. This very aspect is most frustrating to the liberal main media.
The Civil Homeland Defense organization is responding to President George W. Bush's 2002 State of the Union Address in which he called for all Americans to engage in volunteer service and announced the creation of USA Freedom Corps.
