"A few of these little shops that are the targets of these suits are actually fronts for money laundering for organized crime. They might not take too lightly to being the victims of this kind of extortion."How do we know that these lawyers aren't working for organized crime? If all the competition were elimenated, the laundering shops could expand in each locality and launder a lot more money, no? And those shops that elected to "settle" would essentially be paying protection money --a process that we know never ends.

A very old man was near death and he called his three most trusted advisers to his bedside. His physician, his pastor, and his lawyer were told, "I'm old and I'm going to die soon. I've heard you can't take it with you, but I believe with your help I can do just that. On the table there, you will each find an envelope with your name on it. Each envelope has $100,00 in large bills. At my funeral, just before they cover my casket, I want you each to throw your envelope into the grave. Then, if I'm right, I'll have plenty of money in the hereafter."
Shortly after this, the old man died, and the three attended the funeral. Dutifully, each threw his envelope on top of the casket, and they turned and walked from the gravesite.
The pastor was the first to speak. "I'm ashamed of myself. The church had some serious financial problems recently, and I had to take $20,000 out of the envelope to resolve them. My envelope only had $80,000 in it."
The physician was next. "I, too, had some financial troubles. The IRS was hounding me, so I took $30,000 out of my envelope to pay that bill. My envelope only had $70,000 in it.
The lawyer looked aghast at the other two. "Gentlemen, I'm ashamed of you, not living up to your promises. When I threw my envelope in there, it had a check in it for the entire $100,000."

How do we know that these lawyers aren't working for organized crime? Actually their organization is much like that of an organized crime shakedown. It is a form of the extortion that was rampant in the depression era mafias. But rather than threats of violence, these clowns are using a threat of protracted litigation, which can literally bankrupt a small company.
One can only hope that there are some legitimate mobsters out there who are a little bit ticked off that these clowns have started up a shakedown racket in their territory. :-)
BTW I would be willing to bet that these guys are disbarred before next Christmas.

You may well be right about the disciplinary action. What convinces me is not their legal maneuverings, but their mischaracterization of the DA. That's really asking for it.

Yes. Tort reform is a serious (albeit little understood and low profile) problem in the USA that begs correction. At a minimum, plaintiffs should bear the court costs of unsuccessful lawsuits. Beyond that, law firms should be heavily penalized for near-extortion lawsuits such as those described in this post. Should I hold my breath waiting for the Bush admin to lead the charge?

Actually, I was just kidding - I have an attorney, and we're working on it. But I know what you mean about people asking for free advice. When people find out that I'm a former fighter aircraft jet engine mechanic, they never ask me to come take a look at their F-15 or F-16.
But when they find out I'm now a computer tech, it's amazing how many "what if this was happening" scenarios they come up with.

$700,000.00 will buy enough legal firepower to counter sue the scumbag firm for every dime they all made all put together, plus their homes Porsches, Rolexes, lakehouses AND pay for a full page ad in the LA Times warning any other law "firms" they try this little bit of BS and they are next.
That would be justice.

There is also a company named Acacia who is attempting to extort businesses who use video streaming online. They say they patented the technology, but they are not going after any large company....just the small to medium ones.
