Carr jurors get break as deliberation rules ironed out
While jurors take the day off from testimony, lawyers and the judge will be working today in the capital murder trial of Jonathan and Reginald Carr.
Testimony has recessed until Tuesday because of scheduling with an out-of-town expert for Reginald Carr's defense. Jonathan Carr's defense doesn't plan to call any witnesses. The state rested its case Friday morning.
Prosecutors, the defense and Judge Paul Clark will work today on trying to finalize jury instructions. Before the trial ends, the judge will give jurors printed instructions outlining the laws they must follow in deliberations.
The instructions are expected to be lengthy, as they detail each of the 113 combined criminal counts facing each of the Dodge City brothers, including those involved with a quadruple homicide Dec 15, 2000.
Clark has already agreed to consider offering the jury options of several lesser charges, such as first- or second-degree murder instead of capital murder.
If found guilty of capital murder, the Carrs could face the death penalty. The jury would decide that after hearing further evidence.
Tuesday, the defense is expected to call Reginald Carr's estranged wife, Mandy Carr of Dodge City. Lawyer Jay Greeno on Friday told the court he expects Mandy Carr to testify that two remote controls found in Reginald Carr's automobile belonged to her. The white Plymouth also contained items belonging to the victims of the quadruple homicide.
The defense then plans to call its own DNA expert to dispute some findings by the Kansas Bureau of Investigation.
Closing arguments are expected Tuesday or Wednesday.

Take them in the street and beat their brains in with a hammer.
I can't believe they would waste time debating this or having a witness testify. Who the HELL cares who the remote controls belong to?
I don't think that this has been posted, but, both young women were forced to perform oral sex upon each other. I won't use the language that these beasts were using, it's very graphic. The young man that was going to be a priest refused to perform sex on HG, (the living witness) so one brother hit him on the head with the gun and gave him until 11:54 pm to perform. He was unable to get an erection, so the beast started counting down, 11:52, 11:53, etc. Then, he was beaten with the golf club. MY BLOOD IS BOILING!
