And he is a terrorist in any sense of the word.

Oh brother,
for one thing the 14th Amendment applies to states, not the federal government.

Aso for the First, Fourth or Fifth Amendments, you're right in peacetime there would be constitutional problems with arresting and detaining any citizen, regardless of his religion.
However,
1. The Feds have very wide authority to detain and/or deport foreign nationals.

2. It is not a violation of the First Amendment to go after Muslims if the government has a non-discriminatory basis for his actions. And if the government can show that mosques and other Islamic groups have been used for seditious activities, it could take action.

3. Any violation of the "search and seizure" or "due process" clauses of the Fourth and Fifth Amendments that occur in wartime, can really only be remedied by a writ of Habeas Corpus (of course, after the war, Congress can write you a fat check for your troubles). Contrary to what you stated, the constitution DOES let you (well not you, but Congress and the President) suspend Habeas Corpus..."The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it".

We've deported aliens, we've thrown people in internment camps and we've stripped people of citizenship. I think if we look at how FDR and J. EdgarHoover handled domestic security during World War II, we can say that there were excesses (i.e. throwing Japanese women and children into detention camps), but there was not a single successful case of sabotage in the US during the war. We should be so lucky.

I wouldn't doubt that he is following a favorite book right now.

That's a very good point. What IF he's acting out a crime/suspense/murder novel. I'm not a reader of these kinds of books, but maybe LE has thought of this. Are there any Freepers out there who remember ever reading a book with a similar story/plot?

Even Scalia considers Korematsu to be an abomination of constitutional law. I am simply telling you that a similar program today would be declared unconstitutional in about three seconds flat, regardless of what Lincoln or Roosevelt did. Especially when they were acting in far more dangerous situations.

You want to specifically set aside the Constitution to go after Muslims because of this white male between the ages of 21 and 35 is running around shooting people?

You have absolutely no evidence to support the race, gender or age of the shooter. Until you do, quit spewing your prejudiced comments. The ONLY consistent evidence is the matching ballistic profiles of the recovered projectiles from each of the victims.

The appropriate punishment for this sniper is to be turned loose 800 yards downrange at Camp Perry with a signal orange ballcap.

The point I'm trying to make is this: according to reports, this latest shooting has occurred near the sites of six confirmed attacks. So, the common factor in these shootings could be the bus terminal/staging area. Anyone familiar with the area ought to compare the shooting locations with the Ride-On bus routes.

The only real problem I have with that theory is that a Muslim fundamentalist would never say "I am God".

Terrorists need not be are fundamentalists? Atta, Omar sheik and other terrorists were no fundamentalists. They were all Moslem, however.

It is my fervent hope that this scumbag sniper is witnessed in the act by someone from the local population and is run to ground and turned over to the local constabulary about half an hour after the locals kick the ever loving $h!t out of him.

I'm a white male myself. I simply have enough sense to realize that this is typical sociopathic behavior and not an Al Qaeda plot. It is far more likely that this is a traditional serial killer, fitting traditional profiles.

I've seen about 200 "professional" profilers interviewed on FOX News, and all but a very small minority have completely discounted even the possibility that this could be an organized terrorist effort. The denial is now reaching epic proportions. I just think that the possibility is way too frightening for a lot of people to contemplate; they just can't deal with the truth.

The denial of the Feds, on the other hand, is far more deliberate. They've been dead set (since 9/12/01) on denying that any terrorist incidents have happened on our soil, while at the same time being almost irresponsibly quick to pin the word 'terrorism' on any overseas violence. The economy is their first and foremost concern, and if the truth has to be sacrified in the process, so be it.

You are absolutely right. Korematsu v. US, which okayed "internment" or "concentration" camps for Americans of Japanese descent, at the outset of WW II, was one of the most abominable decisions in the history of the Supreme Court. Fred Korematsu's criminal conviction for disobeying President Roosevelt's Executive Order, was overturned 40 years later by a US District Judge.

To it's shame, the US Supreme Court simply left standing, without comment, the trial judge's decision that it had acted unconstitutionally in the original case. That is the only time in history that I know of, where the trial judge ruled that the Supreme Court had violated the Constitution, and the high Court did not take the case, to agree or to reverse.

But it is clear from the history of that case that the Court will NOT uphold today any round-up of American citizens, regardless of type, or reason, or circumstance. Now, illegal aliens are a different matter. If Congress has the guts to do that, the courts will approve, because illegal aliens -- unlike the Japanese Americans -- do not have an existing "right" to be here.

Trust me on this. I wrote one of my books, Manzanar, on the subject of the Japanese Americans in WW II.

I also know the area well and I agree on the use of SUV and/or sidearm. Given the statistical realities it is highly unlikely a LEO will stumble upon shooter in the act or before the fact. IT will be a civilian. What comes after is determinate upon how civilian is armed. An SUV such an Escalade, Excursion, Tahoe etc would easily be sufficient to stop any such shooter inside or outside his vehicle.

IIRC, they were members of a gun club. I thought they shot other people before the kidnapping, but I might be wrong and the only thing they did was the kidnapping. Like the current shooter, they demanded money.
