Five-year old boy raped by 2 fifth grade boys, family sues Board of Ed

One day after school, she later recalled, the boy came home with a broken belt. Another time, his underpants were on backward and soiled.

On April 21, the grandmother said, she overheard the boy ask his 8-year-old brother to "get the two fifth-graders that are hurting me." When she questioned the boy, he told a horrific story.

Over the previous month, two older classmates - one 10, the other 11 - repeatedly raped him in the school lavatory. They yanked down his pants and, as one boy held him, the other sodomized him, the little boy said.

The boy later told police that the two older boys raped him about 10 times. When he tried to tell a teacher about the attacks, she rebuffed him: "No tattle-tales," she said, according to the police report.

Yesterday, the boy and his mother filed a $2 million lawsuit against the Cleveland Board of Education, accusing school administrators of negligence for failing to provide security adequate to prevent the rapes.

"To think that this sort of thing could go on in a school is unbelievable," said Maple Heights attorney David Pomerantz, who represents the boy and his mother. "It's unconscionable that this happened to him, but it's equally unconscionable that a school would allow it to happen. Obviously, they should be supervising kids better in bathrooms."

Reports of the sexual attacks first came to light on April 22, when the boy's grandmother took him to Rainbow Babies & Children's Hospital and a doctor there called police.

Detectives from the police Sex Crimes Unit investigated, and the boy's accused attackers were charged with rape in Cuyahoga County Juvenile Court. They are awaiting trial.

Pomerantz said a case worker from Children and Family Services substantiated the boy's allegations. An agency spokesman, however, said there was no record of the case being investigated or reported.

Schools spokesman Dan Minnich said neither of the boys accused in the case currently attends Cleveland schools. One has been placed at the Berea Children's Home; Minnich didn't know the other's whereabouts. As soon as the allegations were raised, he said, the district launched an internal investigation with Cleveland police, and the boys were removed from Charles Dickens.

Ward 3 City Councilman Zachary Reed, who represents the Mount Pleasant neighborhood around the school, said the allegations are shocking, but shouldn't detract from the area's revitalization.

"Anything can happen in a big-league city," he said. "We need to ensure that nothing like this ever happens in a school here ever again."

This sort of thing is very common, but the vast majority of it is voluntary.

Sorry, I ain't buying that. A first grader goes to school with anticipation of learning and playing with other children his own age. He isn't looking for sex in the boys room with some older boys.

Type/print the information so that one sheet of paper has four complete sections.

Xerox a shit-load of them.

Cut them into individual handbills. Fold each once down the middle and stack them in handful sized 'chunks'. (which would look like 3-dimendional chevrons)

Cruise through appropriate areas, the school, its surrounding neighborhood, etc., tossing out 'chunks' of the handbills.

They'll separate and spread like dandelion seeds, standing up and attracting attention due to the fold.

Use latex gloves during all phases of the operation. Do a pass through each dispersal area to verify no witnesses/cops before releasing handbills.

If asked, right wing wackos might even say something hateful like, "Sue? Let the f***ing bitch sue the night and the wind!"

It would be illegal to do this. I would never suggest such a thing. Some people might even regard direct action such as this as morally wrong.

On the other hand, if the little boy had said that mom and dad smoked funny stuff, the cops would be at the door with ninja suits and MP-5s within 24 hours. Not just that, but if a child said ANYTHING that could be construed as "abuse" in the eyes of the "school official", such as a spanking, Social Services would be all over the parents like flies on s**t.

The age difference in the case you described definitely made it borderline. But the first grader who talked to your pre-school aged son clearly hadn't been complaining to teachers or parents about it. And I hate to break it to you, but until you intervened, your son WAS headed for school with anticipation of sex in the boys room -- he made that pretty clear to you, I thought. The first grader he looked up to had told him that was one of things kids did at school, along with kickball at recess, and spitballs in class when the teacher has her back turned.

Many of the little neighborhood boys probably acquired similar information about what to expect at school. And from your description, it sounded as this had been going on for some years, involving a large number of boys, with little ones moving into the role of older ones as they grew, and NONE of them ever complaining to teachers or parents. This is just very different than a little boy being held down and forcibly and painfully raped by a pair of much larger boys.

"Yes, let's play condoms and cucumbers, but don't be a tattletale.

Incredible how that works. One of my daughter's friends was in 3rd grade and a boy classmate started scaring her. He said he was a vampire, wanted to suck her blood and kept trying to bite her neck. When she told the teacher, she got in trouble for tattling and nothing was said to the boy. Her mother went to the public school, let 'em have it, and then put her daughter in private Christian school. I guess anything goes, rape, bites, etc. except guns that might shoot the teachers.

Frodojr. has been in mechanical working order for about eight years now. Infants are quite capable of erection, and probably have them very frequently, as even tiny boys are apt to play with themselves. The thing is just so small that you'd never notice through a diaper or baggy toddler pants, and most Americans are too squeamish about sex and nudity to let an infant or toddler remain naked and pleasuring himself long enough for the adult to see the results.

The big change at puberty is the arrival of the capacity to ejaculate. Fortunately, the participants in pre-pubescent sexual activity aren't capable of any significant exchange of bodily fluids, so there's little danger of AIDS transmission. But of course, if no one convinces them before they hit puberty that group sex isn't a good idea, middle school will become a public health disaster zone.

Well, it is a school after all. Where else do you expect kids to learn about sex?

It's like auto shop, you have to get some hands on experience to get a passing grade
