Same thing in NY. NYC was(is) liberal, but the rest of the state was conservative. We got tired of being taxed to death for losers in NYC, and they had millions of Democrat sewer rats packed into one square mile, outnumbering the rest of the state. We almost got our freedom, but the Jewish came in wanting their own state, too, because their "ideology" was different than the other two. When they came in, others started, and it was thrown out of court.
Today, NY still suffers from Democrat sewer rat infestation. And sewer rats breed in their holes, making more and more sewer rats.
Upstate is emptying out. Businesses are leaving. The saints are leaving. It's becomming a wasteland, perfect for the sewer rats to infest.

They may have had four that wanted to hear it, but those four knew they wouldn't get a fifth to rule their way. They decided to let the appeal die, rather than bring it up for arguments and lose forever. I think the case will be revisited in another manner after the election is over and the passions have died down. That way they can get an honest ruling.

Under Jersey law, the construction of the Jersey Supreme Idiots is that of equal representation of both major political parties, with any odd number being filled by an "independent". Of course, that didn't stop McGreedy from replacing one of the RINOs with a RAT.

Forester has other problems along with Lautenberg. There are three independents on the ballot as well. And we know that the independents are there only to siphon the fence sitter votes from Forester (worked for Clinton).

The problem is the ticking time bomb it leaves behind:
The fact is, the Dems have gotten away with a blatant and brazen "bait and switch", and quite possibly, they have gotten away with disenfranchising military personnel.

There is clearly federal law on this front, and there needs to be a VERY strong response to this in the next Congress. Hopefully, we have the House and Senate, so we will have a good chance at moving something that imposes a hard cap on the ballots.

We've also got to be a little more willing to fight dirty with the Dems, too. This isn't pleasant, but we have to do it. We've also got to pull together even if we don't necessarily like the Republican. There is NO effing way a third-party guy can win a House or Senate election, so if we don't hang together, we will definitely hang seperately.

Even if Lautenberg is beat at the polls, this is still a loss. SCOTUS has said, loudly and clearly, that state courts can rewrite laws and usurp Constitutional authorities on a whim.

The supreme court acted properly in refusing to become involved in what is a state issue. The problem is the New Jersey sumpreme court.

It was easily thought that the election of a Federal Senator would fall under review for adherence to the Constitution:

Article One
Section. 4. The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.

The federal perview also comes about under the Equal Protection provisions, although, not as comprehensively as it did in Florida...ergo the one sop here that allowed the wishy-washy to duck the issue.

No, I wouldn't have had a problem with their review, especially since the NJSC shouldn't have rewritten law reserved to their legislature in the first place.

Pretty much what happened was they got beaten around by the "personal destruction" machine of the Clintons and their cronies. Pretty much, we have to get ourselves into a position so that we can, at a minimum, push through judicial nominations like crap through a goose and make the tax cut permanent. Anything else will be gravy.

Each week, confirm four or five judges. The Judiciary committee does that non-stop, and dare the Dems to filibuster.

I swear, why don't we just move every bit of existing power in this nation directly to Washington DC. Every law, edict, bill, police control, every bit of it!! Would that make people like yourself happy? No control at the state level at all. Hell, why do we even have state lines anymore?!? Is there anything sacred to the states anymore? Do you even care?

The reason, and the only reason, that the legislature was mentioned in Article I was that it was the responsibility of said state legislature to appoint the Senators from their states. But with our blossoming Democracy and the final nail in the coffin of our Constitutional Republic in the early 20th century, the 17th Amendment put the power into the hands of the uneducated, vote by their hearts and pockets, and not with their mind public. You can't have it both ways. Either allow the states to nominate Senators through the legislature or all gloves are off and both branches at the state level have the capability of changing it to their whims as well
