If the US SC does not issue an injunction reversing the NJ SC by 1 p.m. on Monday, it is not going to do so at all.

That does not mean, however, that the review of the NJ decision is over. If the Court does not issue an injunction, I expect it to announce that it IS taking the case and will issue a fully-briefed, fully-argued decision AFTER the election.

That announcement should be a warning that the NJ SC was wrong. I expect the vote on the merits of the case (but not on the injunction) to be at least 7-2 against the NJ SC, or possibly 9-0 (as was the first US SC decision against Fla. in 2000).

How would that play out if the SCOTUS takes the case but renders the decision after the election? Please tell us more.

If Toricelli quits inside the 51 day limit with voting(absentee) already in play, does his leaving the election constitute a concession? If so, are the rats allowed to continue?

Congressman Billybob: I have a question........there is a case to be heard tomorrow in the federal (circuit?) court about the absentee ballots. If this court rules that the rules cannot be changed in the middle of the game, does that free-up the USSC from having to act at all? Simply put: my question is, can only the SCOTUS over rule SCONJ?

If there's no remedy it's moot. What are they going to do, cancel the election and order a new one?

Do you really think that time limit of 1:00 PM is accurate, or are you just predicting?

I know you have your sources, but don't put something like that here unless you have concrete proof.
