Thanks for your (excessive) praise. In Bush-Gore I, the Supreme Court did, unanimously, what I suggested. But I have zero proof that they did it because of my suggestion. That's obvious coincidence, but not proof. I'll do my best on this case, along with a lot of smart lawyers who are far closer to the center of action than I am. I believe our efforts will be successful. (Of course, this assumes that the NJ SC will throw out NJ law as being "inconvenient.")

The petition to the Supreme Court is NEVER filed before the lower court has ruled. The decision which the losing party (whichever one that is) wants reviewed, must present that decision as an exhibit to the US Supreme Court petition. The Republicans are getting ready to go up (as are the Democrats, in case they lose). And on the sidelines, folks like me are drafting their briefs in favor of the parties. Mine will, of course, be in favor of Doug Forrester and the third-party candidates.

When a case is decided by the highest court in a state, the next step is a writ of certiorari to the US Supreme Court, asking them to take the case. I am currently rough-drafting a brief for the Supreme Court in favor of Forrester, on the assumption that the US SC will take the case, and give counsel about 48 hours to file their briefs. If I get to file one, it will be an amicus curia (friend of the Court) brief on behalf of the American Civil Rights Union. (Do not misread that. Robert Bork is on their Policy Board. They are the opposite of the ACLU.

Yes there are six candidates running for the Senate seat from New Jersey...... Besides the Democrat and Republican, there are one from each of the following Parties: Green; Libertarian; Socialist; NJ Conservative Party

Thanks very much for the info. Some of these guys (the more left-leaning ones) might have gotten a lot of votes, if Torricelli had stayed on the ballot.

Maybe one of them will complain.

In a 7-0 decision, the Justices, six of whom were appointed by GOP Gov. Christine Todd Whitman, said the right of New Jersey voters to have a choice in the U.S. Senate race supercedes a state law that said September 16 was the last day to replace a candidate on the fall ballot.

I don't think the scotus will take up this case... There is no Federal issue here.....according GOP Lawyer who was on HUME show.

The lesson for all time is to learn what happens when one tries to play fair with Democrats.

Remember the 2000 power-sharing arrangement? The Republicans won the Senate but gave the Democrats close to 50-50 committee assignments. They backstabbed Republicans and flipped Jim Jeffords.

Remember Mel Carnahan? John Aschroft graciously stepped aside and let Jean Carnahan take his seat. They backstabbed him and Mrs. Carnahan voted against Ashcroft for AG.

Remember Mel Carnahan? He died before the election but the Republicans didn't fight his ballot. The Democrats are now trying to get away with it again in Hawaii with Patsy Mink. If they have to go to court to argue it, they will point to Carnahan as precedent because the Republicans refused to press the issue.

Remember the new tone in Washington? Bush tried to play nice with Democrats and they fly to Baghdad to declare that Bush is a liar and Hussein is trustworthy.

Remember the vandalized White House? Bush tried to downplay the damage, so the Democrats demanded an apology.

Now this. Watch and learn, Republicans, watch and learn.

Why wouldn't equal protection be a federal issue? People have a right to vote. NJ voters duly elected state reps who passed an election rule. By national Dems and state judges refusing to abide by the rule, doesn't that deny NJ voters a meaningful vote? Doesn't that deny them a right to make their own rules and have them adhered to by politicians? Shouldn't voters be protected, and by the SCOTUS since they're the only people left who can do it?

I knew since yesterday that the pubbies were GOING TO GET SCREWED! Sure enough we got screwed ROYALLY! Can't take it to the USSC, not enough time to fight in courts, and YES the freakin DEMONRATS come out smelling like a rose and the pubbies once again licked their wounds! I'm afraid the RATS are evil-ly cunning and just plain out smarted the pubbies! The rats planned this getup for quite sometime! YEP, this is what you call an OCT. SUPRISE of the lowest kind! You know, the dilemma about always taking the high-road is that, for some reason the Democrats seem to get away with blaming the Republicans anyway. You'd think that people might ask: "Gee! How could people who always takes the high-road always wind up in such trouble while others who always take the low-road are never responsible for scandal after scandal?"
