a- Judges shouldn't consider the cause of a vacancy!!!

I hope you are right, but doesn't it always look that way? The judges ask the tough questions which gives the lawyer a chance to present their argument. Example: Judge says, Why should we let you override the law, which clearly states the deadline? Lawyer says Because we really really want to. Judge says to self, Hmmm, I agree. Looks like the lawyer got hammered, but he didn't.
