Depending of course if the Torch goes throught with the resignation from the campaign or U.S. Senate.

A lot of the reason Dubya won in Florida was that Jim Baker hired all the leading election lawyers in the state right after Election Day 2000. Kept them all from working for Gore -- including the Dem lawyers, like Barry Richard. With their money advantage, the Republicans now need to do the same in NJ.

Forget about the ballot. If Torch resigns from Senate within 30 days of the election, gov can appoint someone to fill the seat until the next election, presumably two years hence. A complete end-run around the ballot box.

What is to prevent successive resignations just before the next election, to continue forever, thus making this senate seat non-elected. If Joe Blow is appointed and serves until 10 days before 2004, then resigns then the Gov. gets to appoint for another two years. It could go on forever. The answer, I belive, is the Constitution trumps these bad state laws. This is both absurd and evil. The Democrats are not just another polictical party, they are evil. We still fight them "inside the rules" but they are the Tyson of politics, low blows, ear biting, whatever it takes. We need a Lennox Lewis figure to clean up the political ring just like he cleaned up boxing by knocking out Tyson. We need to KO the Demmocratic Party. It's too bad the blackmail worked in the impeachment time, we had a shot then.

Even if Torcelli does resign, would it make much difference, vote wise? I heard Jeffords say that he was ready to turn Dem, if he needed to, to keep the majority Democratic.

Exactly. Federal law trumps state law. The term cannot be extended. New Jersey's governor can appoint someone for the REMAINDER of Torricelli's term, i.e. through January 3, 2003. No longer. Torricelli's term was 6 years, not 6 years plus whatever the governor of New Jersey wants to add to it . . .

Which means that if the Democrats fight it out in a long court battle, after 3 January, New Jersey will have only one Senator?

It is my hope that we at FR can frame the democrat party as evil and feckless. If enough democrats see the light and realize what their party really represents and the lengths that they will go to retain power then they may leave the party or become independents.

Agreed, as a Jerseyan, I am infuriated, and repulsed by this and been in rare form all day. I was stupidly just watching CNN and the commentators had a near orgasm about it, since one was a lib writer from Roll Call and the other was a Dem strategist. I know they never claimed to be "fair and balances" other there, but I didn't think they would be so blatant either.

The add'l answer is the statute doesn't say what everyone is reading. The 30 day stuff its only effective when the vacancy occurs for OTHER than the end of the term.

How could that be? That would be extending the term.
