FOX just reported that the paperwork will be ready to go on the New Jersey funny business and rigging elections.
Depending of course if the Torch goes throught with the resignation from the campaign or U.S. Senate.

The national media will protect the Democrats and will spin this to make the Republicans look bad. No matter what the Republican response is, the press will play the Democratic spin in a positive way.

Its not a state issue. The senate seat is a federal office. The election is a federal election and it takes place according to federal laws. Proper court is Federal Court.
Only way I can see Democrats retaining the Senate seat is to 1)run a write-in candidate for whoever they can get to run or 2) keep Torch from resigning January 3, keep his name on the ballot and annonce that he will resign, then say who the governor will replace him with (ala Carnahan). Even that second alternative may not be legal. I cant see how changing the ballot at this point would be legal.
I guess this is different than Florida 2000 in that in Florida, they were electing state electors to the electoral college, not the president himself. In this case, they are electing a federal officeholder.

No f---ing way. The senate term is six years, not one day more. Thats according to the constitution. Torch can quit any time he wants and the governor maybe able to replace him but ONLY for his term. The replacement is dead meat on Jan 3, 2003.

You have asked for an analysis of New Jersey ballot statutes and regulations regarding a possible vacancy in connection with the upcoming election in New Jersey. New Jersey law explicitly provides that when a vacancy occurs among primary nominees, the state committee of a political party committee may select a replacement candidate. N.J. Stat. § 19:13-20. However, this ballot replacement is only allowed when the vacancy occurs more than 51 days prior to the election. Id. Inside of this 51 day statutory window, a replacement candidate can not be put on the ballot. The only exception ever recognized by a New Jersey court was in the case of the death of a nominee. Petition of Koegh-Dwyer, 106 N.J. Super. 567, 256 A.2d 314 (1969), affirmed 54 N.J. 523, 257 A.2d 697. It is worth noting that the time limit was raised from 34 days to 51 days in 1985. Legislative history from the original statute states that time limit was included "to afford election official sufficient time in which to attend mechanics of preparing for general election." Kilmurray v. Gilfert, 10 N.J. 435, 91 A.2d 865 (1952).

Shades of Missouri. If Carnahan loses in Nov. to Jim Talent he can take office right away and not wait until January. The Dims are planning on blocking him from taking office until January.
So it's ok for them to block someone but they will scream bloody murder if the Republicans try to block them.
