Check that analysis. 2 USC Sec 7 reads:

The Tuesday next after the 1st Monday in November, in every even numbered year, is established as the day for the election, in each of the States and Territories of the United States, of Representatives and Delegates to the Congress commencing on the 3d day of January next thereafter.

As this is consistent with Article I, Section 4 cited above (it does not affect the places of choosing Senators), the election must go on as scheduled.

The whole thing STINKS to high heaven of last-minute Democrat voter manipulation. If the Torch backs out of the election because he's guilty of the crimes he's accused of....WHAT DOES THAT TELL US ABOUT SENATE DEMOCRATS WHO HAVE BEEN PROTECTING HIM FOR MONTHS??

There's a reson this is happening at the last minute...an almost October surprise...whatever it is, it isn't good.

I don't see where this rule applies. The term is over at the beginning of next year. There is a scheduled election in November, and candidates are running (I presume there are other candidates besides the Republican and Democrat). Just because one candidate drops out, I do not see how the election can be cancelled. If Torricalli resigns, then the governor should only be able to appoint a successor until January. What am I missing here?

It will still be Torricelli's name on the Nov. ballot, though. Anybody besides Torch would have to be elected as a write-in.

Does anyone honestly believe that the governor is not fully aware of all this and already has a plan in place??

Resignation is a snooker move after Oct 6th. Dropping out of the race would not be quite so bad.

That as much as the public cares about social programs they are more concerned with the lives of their children and grandchildren

And that the public is happy with Bush's leadership

OH SHEET .. Rush just mentioned that he would not be surprised if Bill Clinton fill in for Torch's place

The battle is whether someone else can take the Torch's place on the ballot under the D column. The election laws say Sept 16 was final deadline, but the RAT lawyers are trying to find every loophole imaginable. And the NJ courts may be run by the liberals - I don't know.
