Government Threatens Florida Pastor

Pastor David Mallory has opened the doors and grounds of the First Assembly Ministries in Naples to The Sawgrass Rebellion. He has done this because his own 12-year effort to reach out to the indigent, the poor, and the needy has suffered the oppression of the federal government.

"I love nature, but we should not be enslaved to it, " he said emphatically.

Even as he spoke, he held in his hand a new fax from the Army Corps of Engineers. They threatened his church and the 80-acre campus with a $25,000 fine for allegedly failing to follow their orders.

"When we received our permitting, we were forced to buy 103 acres of offsite mitigation lands somewhere in the Everglades at a cost to the church of $500,000, and set aside 12 acres of onsite mitigation for wetlands," explained Pastor Mallory. "This letter of warning says that we now need some sixteen acres on-site or we will be forced to pay their fine."

He went on to explain that his congregation built small lakes to surround a nature trail on the church campus and they were now being told by the Corps that they needed to support five species of endangered birds. In order to support the endangered birds, three different levels of plant life must be added in the water areas, at a total cost of $15,000. In addition, he was not told what specific species of birds were to be protected.

"How do I know what type of bird I am supposed to be attracting?" he asked.

He was also told by the Corps to remove plants from the property because it was a wetland and then they told him to plant 850 new trees. He complied and was then told by the Corps to plant an additional one thousand trees on church property.

"I am just a minister. I just want to help people. I have been doing this all of my life. I don't understand all the obstacles that have been put in the way of our mission," he said. "Even more than the government, the non-elected people trouble me. I truly believe that the environmental people thwart the true freedoms of all of us and even our elected politicians are powerless to stop them."

His frustration evident, he continued to tell story after story of harassment and interdiction.

He built a six-foot high chain link fence, pursuant to orders from the Corps. When local children dug under the fence, he ordered his crew to move two scoop loads of dirt as fill to stop the trespasses and destruction. "The Corps came in again. I don't know if they watch us every day or what, but they came in immediately and said that we had illegally filled a wetland and we had to pay a $6,000 fine. Then they took eighty feet from around the entire perimeter of our grounds to keep as another wetland protection area."

Mallory, who is a native of Canada, has ministered in South Florida for many years. He said the church was forced to pay to widen the county road next to the campus. They also had to provide the South Florida Water Management District (SFWMD) with two boat ramps going both north and south along a canal that fronts the facility before they would approve the project.

"I am sorry, but I just don't understand the Corps, the SFWMD, or their reasoning. We have had a water meter here for years. We recently had to pay a $25,000 deposit for a water meter, which we already had," he said.

His ministry is fully supported by the Collier County Board of Commissioners, Don Hunter of the Collier County Sheriff's Office and many of the county judges, who send individuals charged with crimes to his facility for treatment and assistance.

"Our goal is to provide shelter and rehabilitation for the indigent, drug and alcohol abusers, and the homeless," he said. "We provide shelter, detoxification, rehabilitation, medical screening, food, clothing, counseling, education, protection for unwed mothers and abused runaway teens, the hungry, or anyone else who needs help. What are we doing that is wrong in the eyes of government officials?"

Mallory believes U.S. veterans are essentially a forgotten part of our society and the ministry is especially receptive to them. A life-size, one-ton bronze sculpture at the entrance of the campus depicts Christ embracing a soldier.

He said one of the goals of the ministry is to provide temporary housing for local individuals in the community. However, housing units on the church campus are empty.

"We can't set them up and open them to the public because Collier County wants $104,000 in impact fees and they want it all up front, even before we begin to house those who need the help," he said in an exasperated tone.

He said that he understood and was receptive to the cause of the Sawgrass Rebellion, because fourteen years ago he was the minister at a small church in inner Florida. However, he declined to identify the parish.

"Let’s just say that the people were the classic ‘Florida Crackers.’ They were the salt of the earth. They helped everyone, with no questions asked," he said sadly. "They invited me and my son Joshua (later killed by a drunk driver along with five others traveling in a church bus) deep into the Everglades to spend the weekend at their camp. I remember traveling in a swamp buggy to a small cabin. We saw wildlife everywhere and it was amazing."

He went on to explain that all those people wanted to do was hunt, fish, and enjoy the recreation in the area, but the federal government took the land, fenced it and made it off-limits. His congregation moved away because they wanted to go on to a place where they could enjoy nature.

"If we can help the Sawgrass Rebellion in any way, the church, our people and our facilities are open to them," he said.

The church campus is located on Collier Boulevard, about two miles south of Interstate 75.

The Sawgrass Rebellion is an umbrella organization founded to protect the property rights of South Florida residents through legislation, litigation, and public education. A national forum and property rights rally is scheduled in Naples on October 17 and 18. Caravans from across the United States will converge at the rally and travel across the Everglades to Homestead, Florida on October 19. The largest property rights advocate group in the United States, The Paragon Foundation of Alamogordo, New Mexico, recently agreed to help South Florida residents in their stand against "unwarranted taking" of their properties.

They have precedence with Jim Thoburn despite how wrong it is. They will lock up the Pastor if he doesn't jump through any hoops they move up or down.

Florida should file a lawsuit against the Feds, the EPA et al, claiming the constitutional right of the State to govern itself with non-interference from federal gov't. It would take years to resolve, and we might lose, but at least we'd clarify where we stand. Then no more hiding; just blatant federal control. State's rights all over again.

That's just CRAZY! Even if they realized he'd never paid a deposit for a water meter, I can't imagine one would cost twenty-five thousand dollars!

When there's homeless people on the street taxpayers cry out for politicians to solve the problem. Some donate money to a politicians' political campaigns in hopes that they will solve the problem.

The $104,000 in impact fees -- the inability to fork over that much money upfront -- ensures that the street people stay on the streets to serve the local politicians political agenda.

The most used mantra of politicians is, "I'm going to use the power of government to help the little guy."

I won't even call it a hoax for it is a bald-face lie. For they must first extort money from one group -- wealthy taxpayers -- skim some money off the top for themselves, spend some on their cronies pet projects and then, most of what is left goes to pay the alphabet-agency's bills and pay the bureaucrats to go out and impose fines and impact fees on people like David Mallory. People like Mallory that are sincere in their words and deeds to help the little guy.

The press is eagerly waiting for the Governor to jump in one month before the election. Our Florida enviral lobby is organized, huge, and will see to it that our Gov. is pilloried in every leftist "hometown" paper from Pensacola to the Keys (most every Fla. paper). The Dems. wish to thank you for the question. Jeb would love to have the property rights advocates on his side when he was facing tough legislation and getting nothing but enviral trouncing in the press. Now it plays into the enemy hands beautifully.

Yeah you're right, why should we expect our own Governor to help those who are being unjustly steamrolled? After all the leftist green goons (who are already sticking it to him anyway) might get mad. Can't let a few thousand farmers, homeowners and Pastors get in the way of preventing bad PR NOW CAN WE.

If you were wondering where the property owners were "when he was facing tough legislation" they were minding their own f***ing business, leading their lives and contributing to the betterment of this country. None of them saw this despicible scourge coming until it was too late.

Keep blaming the property owners for the crimes of the abusive scumbags that are sucking the life out of them, that ought to get you into heaven. God forbid we should count on our own elected officials to to do the right thing.

I guess I should move you from my property rights list to my "phoney" list.

AT THE MINIMUM, IMHO, THERE IS AN ENORMOUS CASE FOR STATES RIGHTS--1,000'S OF CASES FAR AND WIDE--BUT IT SEEMS TO ME, WE HAVE TO GET RID OF THE BILLDO AND SHRILLERY TYPE SUPREME COURT JUSTICES AS WELL.

CERTAINLY we could encourage all such suits as seemed reasonable . . . though I hate suits and feeding more atnys. given so many already at the public trough.

What kind of THINKING OUTSIDE THE BOX might we come up with?

Thinking outside the box? Secession (which is constitutional), or quiet takeover of the legislature of a small state (like NH) by having a bunch of Freepers move there and elect decent fellow Freepers to run the state.

No, AAA, but you had to see how the press would play this one month before the election. Jeb is not perfect, but he's a damn fine Governor. You want McBride? He's FAR left...believes the whole socialist platform from only public schools, to government knows best how to raise your kids, to abortion, gun control, and is a "staunch supporter of the environmental movement." I'll wait for a comment from the Governor...which will be soon, he always responds readily. You will never find your perfect candidate, AAA. You could have enlisted the Governors support...and most Republicans in Florida. Now, if Jeb loses, "property rights" loses as well.

You can take me off your list. This crap breaks my heart when we need to unite against a major enemy.

I just thought I'd offer a comforting thought here.

Our county commisioners who are part of this monstrosity, are being sued PERSONALLY, for civil rights violations. They'll be spending plenty of time (that would normally be spent making their constituants lives miserable) defending themsleves PERSONALLY in court.

Lawyers that take a pound of flesh out of an arrogant politicians ass are the type of lawyers I can live with. It's just unfortunate that it had to come to this.

When your ass is on the line, or worse yet your homestead (basically that which is the center of your life) you don't really give to craps who does what, all you want is help, from ANYONE. You better pray to your God that you never have to learn that first hand.

Governor Bush has plenty of time to do the right thing. I reject the petty argument that doing the right thing has to cost him politically. If he acts righteously, he'll have thousands upon thousands of enthusiastic friends and supporters.

Part of leadership is having courage to right wrongs, but then again the entire Bush family is known for being chickens**t when it comes to standing up to their political opponants if they think it would cost them one penny of political capital.

Your contention that we should give up our way of life so that Jeb doesn't receive the ire of extreme leftists is assinine. Real leaders have the courage to bring people around to supporting what's right, they don't sacrifice others in order to keep their hands clean.

Those stupid pathetic campaign commercials that show how wonderful Jeb is because he put a traffic light in an intersection (you know the one where the cute little kids are walking across the street) disgust me.

What about the cute little kids in our very area that wake up and find 6 inches of water in their front yard and their parents income destroyed because of dead crops? I guess those cute little kids don't matter at election time.

Your heart breaks for nobody.
